ARTICLE 32 HEARING FOR ARMY OFFICER WILL RECONVENE IN GERMANY

BAGHDAD - On June 12, 2004, Cpt Rogelio M. Maynulet of the 1st Armored Division was charged with murder and dereliction of duty for the suspected killing of an Iraqi male on May 21, 2004.

The charges stem from an incident in which U.S. forces near Kufa came into contact with a black sedan believed to contain militia forces. A chase began, and U.S. forces shot at the vehicle. The driver and a passenger were wounded. Shortly thereafter, the wounded driver was shot and killed at close range.

An Article 32 investigation began on June 25, 2004. The investigation adjourned on June 28, 2004, for the period of First Armored Division’s redeployment from Iraq to Germany.

The Article 32 investigation will reconvene in Germany in late July.

During the Article 32 investigation, an impartial officer will inquire into the truth set forth in the charges and make recommendations as to disposition of the case.

The Article 32 investigation is closed due to a motion by Cpt Maynulet’s defense team and due to the presentation of classified evidence.

No further comment would be appropriate while this investigation is pending.
