Federal Register Document Drafting Handbook October 1998 Revision ; Supplement 2 Corrections to a Rule May 1, 2004 The Office of the Federal Register is amending the Federal Register Document Drafting Handbook by revising "Section 4.6, Corrections to a rule." Currently, section 4.6 states that if the revision date of the CFR volume for the rule has not yet occurred, you may format the correction as a correction to the rule document itself, as published in the FEDERAL REGISTER. Previously, our CFR editors were able to incorporate these changes when they updated the printed CFR volume after the revision date had passed. However, since the advent of the electronic CFR, our editors now update the CFR electronically and insert each change when the effective date of the rule arrives. Under this system, it is necessary for corrections to CFR text that are published after the effective date of the original rule occurs to be formatted as correcting amendments to the CFR. Note that only rule document corrections are affected by this change. Then format for corrections to proposed rule and notice documents is unchanged. The new section 4.6 reads as follows: 4.6 Corrections to a rule. Nonsubstantive errors. If you discover obvious misspellings or other nonsubstantive errors in CFR text as set out in a rule document, your Liaison Officer should contact our Code of Federal Regulations unit. We sometimes make these corrections in the next edition of the CFR without requiring a Federal Register correction. Substantive errors. You must publish a document in the Federal Register to correct substantive errors in your original document. A document that corrects a previously published rule must: * Repeat the agency headings of the document being corrected. * Carry a CFR heading for only the CFR parts affected by the correction (list all CFR parts if the preamble is corrected). * Repeat the Docket number. * Repeat the RIN number. * Repeat the subject heading of the document being corrected with a semicolon and the word "Correction" added at the end. * Follow the preamble requirements for a rule. * Effective Date -- You must furnish one for rule corrections. The effective date for a rule correction may not be earlier than the effective date of the rule you are correcting. * To correct an entire paragraph, set out the section heading, and use asterisks. See section 2.14 of this handbook. There are two different formats for correcting regulatory text in a rule document. Both require signed documents. The format used depends on whether the effective date of the rule has occurred. Note: If you are correcting only a docket number or preamble text, use the format in Example 1, even if the effective date has passed. If the effective date of the rule you are correcting has not yet occurred, use the format for corrections to the Federal Register: Example 1: Corrections to the Federal Register. The Food and Drug Administration published a rule on December 23, 2002 which will become effective on December 23, 2004. On April 14, 2003 (before the effective date), FDA published a correction to the Federal Register. That document inadvertently failed to update the station class for frequency 464.575 MHz listed in Sec. 90.35(b)(3) and incorrectly listed a cross-reference in Sec. 90.267(e)(3).
