Ineligible under Section 221(g)

Applicants are ineligible under Section 221(g) because some document or information, such as an Certificate of Eligibility for Nonimmigrant Student Status (I-20), SEVIS confirmation, or a valid passport, is missing. If you are ineligible under Section 221(g), we will give you a green ineligibility letter, listing what is needed and explaining how to reapply. Follow the instructions carefully and re-submit your visa application.


Your re-application must include:


blue square A signed passport valid for more than six months.

blue square A completed and signed Nonimmigrant Visa Application (DS-156/DS-157) with photo (See "new photo requirements" for the DS-156) and Contact Information And Work History For Nonimmigrant Visa Applicant (DS-158) for all F, M, J applicants.

blue square A receipt from the HanMi (KorAm) Bank for the US$100 visa processing fee. The fee may be paid at any of the bank's branches in Korea. There is a branch only a short walk from the Embassy; here is a map. A new visa application fee is NOT required for 221(g) ineligibilities within one year.

blue square A courier receipt from an Embassy-approved courier company (DHL: 1588-0002; Hanjin: 1588-0011). Please contact DHL or Hanjin courier company directly for pick up and delivery information.

Follow one of the instructions below indicated on your 221(g) ineligibility letter.

blue square Please reapply by personal interview. No appointment is necessary. Please appear at the intake windows any workday at 8:30 am or 1:00 pm (except Wednesday afternoon).




Ineligible under Section 214(b)

If an applicant is found ineligible under Section 214(b), we recommend that he/she reapplies only after his/her current family, social, professional or economic circumstances have changed significantly or if there are relevant facts that were not presented at the initial interview. Applicants who are ineligible under Section 214(b) are given a orange ineligibility letter.


If you choose to reapply within one year from the date of your refusal, you may only reapply in writing through an Embassy-approved courier company (DHL or Hanjin). If your reconsideration case is denied, you must wait one year from the date of your first ineligibility to apply again. Please note that reconsiderations can take several weeks for processing.

Your reconsideration must include:

blue square The orange ineligibility letter.

blue square A statement typewritten in English detailing the relevant facts you wish to make known to the consular officer to consider in your case.

blue square Any relevant documents to support your statement including a clear photocopy of all pages in your passport. Please do not send us your passport.

blue square Documents showing sufficient financial resources for your intended stay in the U.S.

blue square A courier receipt from an Embassy-approved courier company (DHL: 1588-0002; Hanjin: (1588-0011). Please contact DHL or Hanjin courier company directly for pick up and delivery information.

Please do not submit your passport or any original documents with your reconsideration case.

If you apply one year after your refusal, you may do so by scheduling an appointment for an interview or, if otherwise eligible, use one of our personal appearance waiver (PAW) programs. Please schedule an appointment at www.us-visaservices.com. You must submit all the required application materials. Please see the information on this website for the visa category you will be applying for.

Applicants who have been previously found ineligible for a visa under Section 214(b) and qualify for a PAW may still be asked to appear for an interview.

Our consular officers give ineligibility letters to all ineligible applicants explaining the section of law under which they are ineligible for a visa and any recourse.
