Ethics 

Subpoena/Deposition Requests


If you receive a subpoena or deposition request related to your official duties, immediately contact the REE Ethics Office at 301-504-1442 before you provide any testimony or produce any documents.

The REE Ethics Advisor will need a copy of any materials you receive including copies of any subpoenas.

Until you receive notice from the REE Ethics Advisor:

  • Do not provide any documents, information, or testimony to any individuals until advised to do so by the REE Ethics Advisor.
  • Do not write letters to any attorney or party to the case except to advise them that you have referred this matter to the REE Agency Ethics Advisor.
GENERAL RULE: No employee may provide expert or factual testimony or produce documents arising out of, or relating to, Federal employment in judicial or administrative proceedings unless authorized by their Agency Administrator with the concurrence of the USDA Office of General Counsel.

In the event that information sought from you is not related to your official work, you may in most instances treat the incident as an outside activity (see REE P&P 461.6)
