This Notice reinstates Notice PIH 2002-17 (TDHEs), same subject, for another year until October 31, 2004. The Notice expired June 30, 2003.

This Notice provides guidance on the circumstances under which public housing agencies (PHAs) are required to disclose information they maintain on recipients of assistance to law enforcement authorities. The Notice also discusses what is required of the PHA and what is required of the law enforcement agency.

The purpose of this Notice is to remind tribes and tribally designated housing entities (TDHEs) who are recipients of federal funds of their obligation to comply with pertinent laws and implementing regulations that provide for non-discrimination and accessibility in federally funded housing and non-housing programs for people with disabilities. Additionally, this Notice clarifies certain information in Notice PIH 2002-01 (HA), Accessibility Notice: Section 504 of the Rehabilitation Act of 1973; the Americans with Disabilities Act of 1990; the Architectural Barriers Act of 1968; and the Fair Housing Act of 1988, as it applies to HUD's Native American programs specifically. Both PIH 2002-01(HA) and this Notice are equivalent in their instructions; however, this Notice outlines the provisions of PIH 2002-01 that apply only to HUD's Native American Programs.

This Notice provides suggestions on how public housing agencies (PHA) that administer Public Housing and/or Housing Choice Voucher programs can help support the President's initiative to end chronic homelessness.

This Notice sets forth procedures for the procurement of legal services by Public Housing Agencies (PHAs). This Notice supersedes similar guidance previously provided to HUD staff and PHAs including PIH 90-47, Procedures for Procuring Professional Services. This Notice is not intended as the primary source of guidance in this area, but is provided to remind all HUD Offices and PHAs of the proper procedures for procuring legal services and to briefly review areas of common interest and concern. This Notice applies to all PHA procurements of legal services that are funded in whole, or in part, with HUD grant funds subject to 24 CFR part 85 (e.g., Operating Fund subsidies and Capital Fund).

This Notice implements changes to the funding of the Housing Choice Voucher Program resulting from the Federal Fiscal Year (FFY) 2003 Omnibus Appropriations Act (Public Law 108-7), which was signed into law on February 20, 2003. In this law, Congress revises the method of calculating renewal funds, separates funding for Housing Assistance Payments (HAP) from funding for public housing agency (PHA) administrative expenses, appropriates funds for a central fund and for administrative expenses, and prohibits the use of FFY 2003 funds for over-leasing.

This Notice provides Public Housing Agencies (PHAs) with information needed to complete their FFY 2004 operating budgets and subsidy eligibility calculations. It includes a schedule for the submission of certain items to HUD, as well as local inflation factors, data needed for the recalculation of the Formula Expense Level, and other special notes related to the Operating Subsidy calculation and processing. Following review of the submitted material, HUD will determine funding levels. The amount obligated by HUD will be scheduled for eLOCCS drawdown.

This Notice provides guidance to small PHAs on how to prepare and submit 1) a new Small PHA Streamlined Annual PHA Plan, and 2) a new streamlined Annual Plan submitted only in years in which a 5-year PHA Plan is also due ("Five-Year/Annual PHA Plan"). The Notice also explains other deregulatory changes applicable to small PHAs and to all PHAs contained in the June 24, 2003 final rule.

The purpose of this notice is to emphasize the importance of reporting homeownership activities under the housing choice voucher program in PIC, alert Public Housing Agencies (PHAs) that the accuracy of Form HUD 50058 submissions on families participating in the homeownership program is inadequate and problematic, and review the HUD Form 50058 reporting procedures.

The purpose of the Notice is to provide public housing agencies (PHAs) information and guidance on the Fiscal Year (FY) 2003 Capital Fund. It also provides other program information regarding the Capital Fund.

This Notice provides Public Housing Agencies (PHAs) with additional information needed to complete the FFY 2003 subsidy eligibility calculations. It includes updated instructions to historical revision and adjustment policies. Additionally, this Notice updates the proration factor.

This Notice discusses the reinstatement of the public housing community service and self-sufficiency requirement authorized under Section 12 of the United States Housing Act of 1937, as amended, (the Act).

This Notice supersedes Notice PIH 2001-42 (TDHEs), Total Development Costs (TDC), dated November 30, 2001. This Notice transmits the updated schedule for the maximum amount of funds that may be used for affordable housing under NAHASDA.

Reinstatement - Notice PIH 2001-39 (ONAP), Line of Credit Control System (LOCCS/VRS) for the Indian Housing Block Grant Program

This Notice applies to the Housing Choice Voucher Program. The Notice transmits a revised Request for Tenancy Approval (RFTA), Form HUD-52517 (03/2003) and provides guidance to public housing agencies (PHAs) and HUD field office staff on the use of the form to obtain information on rents charged by the owner for comparable unassisted units in the same apartment complex. This notice also clarifies requirements for determining comparable rents relative to determining rent reasonableness.

This Notice provides advice to public housing agencies (PHAs) for obtaining Federal Bureau of Investigation (FBI) National Crime Information Center (NCIC) database criminal history record information and fingerprint checks that will assist PHAs with their applicant screening, lease enforcement and eviction responsibilities.

Capital Fund - Replacement Housing Factor Funding Instructions

This Notice updates Notice 99-19 to reflect changes to the requirements for demolition and disposition processing, as well as revisions made to the associated application form HUD-52860 in 2002.

The purpose of this Notice is to:
a. Explain procedures for establishing public housing development cost limits consistent with the Quality Housing and Work Responsibility Act of 1998.
b. Transmit the updated schedule of unit Total Development Cost (TDC) limits.

This Notice reinstates Notice PIH 2001-26 (HA), except for paragraph II.B.1, Early Availability of Funds for Obligation, until February 28, 2004. It expired August 31, 2002.

This Notice provides guidance on generally accepted accounting principals (GAAP) and on the financial statement presentation requirements for participants in the Indian Housing Block Grant (IHBG) Program, Indian Community Development Block Grant (ICDBG) Program and other programs administered by the Office of Native American Programs (ONAP). This Notice also serves to clarify and/or correct advice that recipients may have received regarding applicability of GAAP to their costs and accounting systems.

This Notice provides general guidance to Public Housing Agencies (PHAs) administering Public Housing and/or Housing Choice Vouchers and Section 8 Moderate Rehabilitation programs, and owners participating in the Housing Choice Voucher program, on providing support for families and dependents of military personnel (including reservists and guardsmen) who are called to active duty in the Persian Gulf Region.

The Department is concerned that the delay in FY 2003 IHBG funding may have an adverse effect on some tribes. This Notice provides instructions to tribes and tribally designated housing entities (TDHE) on the process for requesting an advance of IHBG funds for FY 2003. It also provides instructions to Area Offices of Native American Programs (AONAP) on how to review and process a request.
