Announced Action for June 8, 2004

Request for public comment: The Federal Trade Commission is seeking public comment to aid staff in preparing a study examining “the effects of requiring that a consumer who has experienced an adverse action based on a credit report receive a copy of the same credit report that the creditor relied on in taking the adverse action.” The study, which the Fair and Accurate Credit Transactions Act (FACTA) requires the FTC to undertake, must examine the extent to which providing such reports to consumers would increase consumers’ ability to identify errors in and remove fraudulent information from their credit reports. Comments can be sent via electronic mail to FACTAStudy@ftc.gov. Written comments should refer to “FACT Act Section 318(a)(2)(C) Study, Matter No. P044804” on both the text and the envelope, and should be mailed or delivered to: Federal Trade Commission, Office of the Secretary, Room H-159 (Annex M), 600 Pennsylvania Ave., N.W., Washington, DC 20580. Comments containing confidential material must be filed in paper form. The FTC requests that any comment filed in paper form be sent by courier or overnight service if possible because U.S. postal mail in the Washington area and at the Commission is subject to delay due to heightened security precautions. Comments must be received by July 16, 2004. The Commission vote authorizing publication of the Federal Register notice was 5-0. FTC to hold roundtable discussion: The Commission will hold a roundtable discussion on June 30, 2004, to aid the FTC staff in conducting a study of the accuracy and completeness of consumer reports, as required by the Fair and Accurate Credit Transactions Act (FACTA). FACTA, which was signed into law on December 4, 2003, amends the Fair Credit Reporting Act (FCRA). The roundtable will be hosted by the FTC’s Bureau of Economics, and will bring together scholars, researchers, and other relevant parties. The roundtable will not deal with policy issues. A Federal Register notice announcing the roundtable will be published shortly.

Persons seeking to attend the roundtable should contact Marie Tansioco at 202-326-3613 (FTC, Bureau of Economics, 601 New Jersey Avenue, N.W., Washington, DC 20580) by June 18, 2004, and should include in their requests a statement explaining their expertise in or knowledge of methodologies relevant to assessing the accuracy and completeness of consumer reports.
