The Supreme Court of Pennsylvania has affirmed a lower court ruling that removed the name of independent candidate Ralph Nader from the presidential ballot in Pennsylvania. As a result, Mr. Nader is not a certified candidate for President in Pennsylvania. Some absentee ballots that were mailed to Pennsylvania citizens covered by the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA) between September 20 and October 3 list Mr. Nader’s name. Any votes for Mr. Nader will be treated as write-in votes. Votes for all other candidates will be tallied as usual -- no further action from voters is required.
For those overseas citizens who have not received their Pennsylvania state absentee ballot, you may still vote and submit a Federal Write-In Absentee Ballot (FWAB). FWABs may be obtained from a U.S. Embassy or Consulate, a Unit Voting Assistance Officer, an overseas citizen organization such as the Democrats Abroad or Republicans International Abroad, or use the official on-line version of the FWAB that is available at www.fvap.gov.
If the ballot is received by the local election official by Friday, October 29, 2004, votes for all offices on the ballot will be counted. As required by Federal law, only a vote for President will be counted for those ballots received by the local election official after Friday, October 29, 2004, but before the close of polls on November 2, 2004.
