ESIGN SECTION 105(a) STUDY

On June 27, 2001, the Commerce Department and the Federal Trade Commission (FTC) released a report on the consumer consent provision in the Electronic Signatures in Global and National Commerce Act (ESIGN) and its benefits to e-commerce. [Press Release][Report in .pdf format]

On June 29, 2001, NTIA released a report from the Department of Commerce to Congress directed by Section 105(a) of the Electronic Signatures in Global and National Commerce Act ("ESIGN Act") on the effectiveness of electronic mail in the delivery of records, as compared with the delivery of records via the United States Postal Service and private express mail services. The report is available in HTML and pdf formats.


The Commerce Department's National Telecommunications and Information Administration (NTIA) and the Federal Trade Commission (FTC) hosted a workshop on April 3, 2001, to explore the impact on consumers of a requirement to obtain the consent of consumers to receive information electronically. The Workshop was prompted by a provision in legislation passed by Congress last June that required the Secretary of Commerce and the FTC to study the benefits of the consent requirement to consumers and the burdens on electronic commerce.
