The purpose of this site is to provide you with information about
requesting Defense Contract Management Agency records under the Freedom
of Information Act (FOIA).
The FOIA gives any person the right to request access to records of the Executive
Branch of the United States Government. The records requested are disclosed unless
they are protected by one or more of the exempt categories of information found
in the FOIA. Records that, generally, may be protected from disclosure are: Properly
classified material; limited kinds of purely internal matters; matters exempt
from disclosure by other statutes; trade secrets or commercial or financial information
obtained from a person and privileged or confidential; internal agency communications
that represent the deliberative, pre-decisional process, attorney work product,
or attorney-client records; information that would be a clearly unwarranted invasion
of personal privacy; law enforcement records to the extent that one of six specific
harms would result from disclosure; bank examination records; and oil well and
similar information.
Notwithstanding the above protections, the FOIA requires Federal agencies to
provide the fullest possible disclosure of information to the public. Administrative
and judicial remedies are available to those persons denied access to records.

Lists of Names
In
the aftermath of the terrorist attacks
of September 11, 2001, the
Department of Defense (DoD) reviewed
its policy regarding the release
of names and identifying information
of personnel not assigned to
units protected from release
by 10 USC § 130b. As a result of this review,
and in accordance with the Under Secretary of Defense memo dated November
9, 2001, reference: OI-COOR-101, SUBJECT: Withholding of Personal Identifying
Information Under the Freedom of Information Act (FOIA), this Agency
does not maintain for the public’s
use a telephone directory, a list
of credit card holders, a list of names
of employees, or site maps.
- IMPAC
Card Holders
Certain
DCMA employees are authorized to purchase
supplies using the International Merchant
Purchase Authorization Card (IMPAC) program.
This Agency has no specific requirement
to maintain "listings of IMPAC holders" for
program administration or to facilitate
public access that would identify DCMA
employees who hold IMPACs. Individuals
interested in contacting DCMA IMPAC holders
should write each DCMA office directly.

Contracts/Unit
Price Information
DCMA does not ordinarily release unit prices information
from contracts not awarded by this Agency. This policy
is based on the recent federal court ruling in McDonnell
Douglas Corp. v. United States Dep't of the Air Force,
215 F. Supp. 2d 200, 205-09 (D.D.C. 2002). For information
about a contract not awarded by this Agency, please address
your FOIA request to the agency that awarded the contract.
- CMA Contracts
Some
recent DCMA contracts are available to you below. The unit price
information has been removed based on exemption b4 under the FOIA.
If you are seeking this information from a DCMA awarded contract,
please see the DCMA FOIA handbook for information on how to make
a FOIA Request.
- Locating a Contracting Office or Audit Reports
If
the DoD contract number is known (e.g.,
DACA63-03-D-0005), the contracting
officer may be identified by referring
to Appendix
G of the DoD FAR Supplement for
all contracts issued prior to November
2003. Scroll down near the bottom
of the page to locate Appendix
G. Appendix G is arranged by DoD
Component, so knowing the parent
organization (e.g., Army, Navy,
Air Force, etc.) of the contracting
officer makes it easier to locate
the contracting activity. The first
grouping of letters and numbers
prior to the first dash in the
contract number is the DoD contracting
officer identifier (e.g., DACA63
identifies the U.S. Army Engineer
District, Fort Worth). Once the
DoD contracting officer has been
identified, requesters seeking
copies of contracts or Defense
Contract Audit Agency (DCAA) audit
reports may direct their Freedom
of Information Act request directly
to that activity. DoD contracting
activities have the sole discretion
of release for audit reports prepared
for it by the DCAA. Requesters
seeking audit reports must make
their requests directly to the
DoD contracting activity rather
than DCAA.
NOTE: The link cited above is the last issuance,
October 1, 2003, of Appendix G of the DoD
FAR Supplement. Earlier versions of Appendix
G to the DoD FAR Supplement, which will
be useful for older contracts, may be found
on the Defense
Procurement and Acquisition Policy website
(See gray box with drop down menu, “Browse the DFARS”).
In November 2003, all contracts issued
by the Department of Defense began
using the DoD Activity Address Code
(DoDAAC) as part of the contract
number (e.g. W9126G-04-D-0001, note:
W9126G is the DoDAAC). DoDAAC codes are
not currently publicly available. Requesters
seeking copies of contracts or DCAA
audit reports issued on newer DoD
contracts, will need to submit FOIA requests.
