Final Determination in the Antidumping Duty Investigation

on Imports of Certain Aluminum Plate from South Africa

On October 5, the Department announced its final affirmative determination in the antidumping duty investigation on imports of certain aluminum plate from South Africa.   The Department determined that South African producers/exporters have sold certain aluminum plate in the U.S. market at less than fair value, with a margin of 3.51 percent.  

Next Steps:   The U.S. International Trade Commission (ITC) is scheduled to announce its final injury determination on or about November 18, 2004.   If the ITC makes an   affirmative determination that imports of aluminum plate from South Africa are materially injuring, or threaten to material injure, the domestic industry in the United States, the Department will issue an antidumping order, and instruct U.S. Customs and Border Protection to collect antidumping duties on the subject imports.   If the ITC makes a negative injury determination, the investigation will be terminated and no order will be issued.

Petitioner: The petition requesting this investigation was filed by Alcoa, Inc. (Pittsburgh, PA).

Product Description:   The merchandise covered by this investigation is 6000 series aluminum alloy, flat surface, rolled plate, whether in coils or cut-to-length forms, that is rectangular in cross section with or without rounded corners and with a thickness of not less than 0.250 inches (6.3 millimeters).   6000 Series Aluminum Rolled Plate is defined by the Aluminum Association, Inc.   Excluded from the scope of this investigation are extruded aluminum products and tread plate.

The merchandise subject to this investigation is currently classifiable under subheading 7606.12.3030 of the Harmonized Tariff Schedule of the United States (HTS).   Although the HTS subheading is provided for convenience and customs purposes, the written description of the scope of this investigation is dispositive.
