To establish an alternative trigger for determining if an extended benefit period is in effect for a State for purposes of certain benefits under the Temporary Extended Unemployment Compensation Act of 2002.

Mr. WALDEN of Oregon (for himself, Mr. DEFAZIO, Ms. HOOLEY of Oregon, Mr. WU, Mr. BLUMENAUER, and Ms. DUNN) introduced the following bill; which was referred to the Committee on Ways and Means
A BILL
To establish an alternative trigger for determining if an extended benefit period is in effect for a State for purposes of certain benefits under the Temporary Extended Unemployment Compensation Act of 2002.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. ALTERNATIVE TRIGGER.
(a) IN GENERAL- Section 203(c)(2) of the Temporary Extended Unemployment Compensation Act of 2002 (26 U.S.C. 3304 note) is amended--
(1) in subparagraph (A), by striking `or' at the end;
(2) in subparagraph (B), by striking the period and inserting `; or'; and
(3) by adding at the end the following:
`(C) such a period would then be in effect for such State under such Act if--
`(i) the State law of such State provided for the alternative trigger described in section 203(f) of such Act, applied in accordance with clause (ii); and
`(ii) such section 203(f) were applied by disregarding clause (ii) of paragraph (1)(A) thereof and any reference to such clause.'.
(1) IN GENERAL- The amendments made by this section shall apply in determining whether an extended benefit period is in effect for a State for purposes of determining eligibility for TEUC Second Tier benefits based on an exhaustion of TEUC First Tier benefits occurring on or after the date of the enactment of this Act.
(2) DEFINITIONS- For purposes of this subsection--
(A) the term `TEUC First Tier benefits' means any benefits, other than TEUC Second Tier benefits, payable to an individual under the Temporary Extended Unemployment Compensation Act of 2002; and
(B) the term `TEUC Second Tier benefits' means benefits payable to an individual under the Temporary Extended Unemployment Compensation Act of 2002 based on a determination under section 203(c) thereof.
