Q: What guidance does FDA have for manufacturers of Poultry and Poultry Products?


 A: Poultry and poultry products offered for importation and those distributed domestically are subject to the Poultry Products Inspection Act, which is enforced by the Food Safety and Inspection Service to which inquiries concerning such products should be addressed. The term "poultry" means any live or slaughtered domesticated bird (chickens, turkeys, ducks, geese, or guineas), and the term "poultry product" means any poultry carcass or part thereof. Excepted from the definition of "poultry product" are products that contain poultry ingredients only in relatively small proportion or which historically have not been considered by consumers as products of the poultry food industry. These products are exempted by the Secretary of Agriculture from definition as a poultry product under such conditions as the Secretary may prescribe to assure that the poultry ingredients in such products are not adulterated and that such products are not represented as poultry products (9 CFR 381.15).

Poultry and poultry products are also subject to the Federal Food, Drug, and Cosmetic Act to the extent to which the provisions of the Poultry Products Inspection Act do not apply.
