Mr. BROWN of South Carolina (for himself, Mr. AKIN, Mr. BARRETT of South Carolina, Mr. BEAUPREZ, Mr. BOOZMAN, Mrs. JO ANN DAVIS of Virginia, Mr. DEMINT, Mr. FOLEY, Mr. GARRETT of New Jersey, Mr. HAYES, Mr. OSBORNE, Mr. PENCE, Mr. PITTS, Mr. ROGERS of Michigan, Mr. SOUDER, and Mr. WILSON of South Carolina) introduced the following joint resolution; which was referred to the Committee on the Judiciary
JOINT RESOLUTION
Proposing an amendment to the Constitution of the United States respecting real and virtual child pornography.
Resolved by the Senate and House of Representatives of the United States of America in Congress assembled (two-thirds of each House concurring therein), That the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by the legislatures of three-fourths of the several States within seven years after the date of its submission for ratification:
`Article--
`SECTION 1. Neither the Constitution nor any State constitution shall be construed to protect child pornography, defined as visual depictions by any technological means of minor persons, whether actual or virtual, engaged in explicit sexual activity.
`SECTION 2. The Congress shall have the power to enforce this article by appropriate legislation.'.
