EIS Comment Letters

    ALASKA
    Draft EIS - Alpine Satellite Development Plan, Construction and Operation of Five Oil Production Pads, Associated Well, Roads, Airstrips, Pipelines and Powerlines, Northeast Corner of the National Petroleum Reserve--Alaska, Colville River Delta, North Slope Borough, AK.
    Summary: EPA expressed environmental objections with Alternatives A and C because of the potential for significant adverse impacts to environmental and subsistence resources and the users of the plan area. Neither alternative would be consistent with oil and gas lease stipulations in the 1998 NW NPR-A Record of Decision. In addition, the Draft EIS does not contain adequate information regarding other reasonable alternatives, such as the State of Alaska's proposed road to Nuiqsut, and additional mitigation for impacts if stipulations are excepted or amended. EPA recommends changes to the proposed alternative to address these issues and that the final EIS include mitigation measures and environmental safeguards to minimize significant adverse impacts.     Draft EIS - Essential Fish Habitat, Identification and Conservation, Implementation, North Pacific Fishery Management Council, Magnuson-Stevens Fishery Conservation and Management Act, AK.
    Summary:
    EPA expressed concerns for rescinding Habitat Areas of Particular Concern. EPA requested additional information on an ecosystem approach for identifying Essential Fish Habitat, the potential for increasing the Observer Program and Environmental Justice/Tribal Consultation.

    Draft EIS -- Bering Sea and Aleutian Islands King and Tanner Crab Fisheries and Fishery Management Plan, Implementation, United States Exclusive Economic Zone (EEZ) off Alaska.
    Summary:
    EPA has no objection to the action as proposed.

    Draft EIS -- Resurrection Creek Stream and Riparian Restoration Project, Proposes to Accelerate the Recovery of Riparian Areas, Fish and Wildlife Habitat, Chugach National Forest, Seward Ranger District, Kenai Peninsula Borough, AK.
    Summary:
    EPA expressed environmental concerns with the potential release of mercury from restoration activities to the creek and the ultimate placement and disposal of the tailings. EPA recommended that the final EIS detail where the tailings will be placed and provide additional information on the mitigation measures related to identifying and disposal of mercury found during project implementation.

    Draft EIS -- Alaska Peninsula and Becharof National Wildlife Refuges, Draft Revised Comprehensive Conservation Plan, Implementation, AK.
    Summary: EPA has no objection to the proposed management strategy for the refuges.

    Draft EIS -- Couverden Timber Sales, Harvesting Timber, NPDES, Coast Guard Bridge Permit, U.S. Army COE Section 10 and 404 Permits, Tongass National Forest, Juneau Ranger District, Chilkat Peninsula, AK.
    Summary:
    EPA expressed concerns about the effect of new forest roads on water quality and requested that the Forest Service consider the closure of more existing and new roads following harvest. EPA also requested that the Forest Service consider selecting Alternative 5, which avoids clear cutting and does not propose new forest roads.

    Final Programmatic EIS - Army Transformation of the 172nd Infantry Brigade (Separate) to a Stryker Brigade Combat Team (SBCT), Propose Location Forts Wainwright and Richardson, AK.
    Summary: EPA continues to express concerns related to soil and water resource impacts. EPA stated that the Army's monitoring and management programs for training areas must be fully implemented to repair the predicted damage.

    Draft EIS - Unalaska Navigation Improvements Project, Construction of Harbor on Amaknak Island in Aleutian Island Chain, Locally known as LittleSouth America, Integrated Feasibility Report, Aleutian Island, AK.
    Summary: EPA expressed concerns that the proposed mitigation may not be adequate to compensate for productive intertidal and subtidal habitat adversely impacted by the project. EPA requested that the Corps consider additional mitigation at sites identified in the draftEIS or other sites if appropriate. EPA also requested that the final EIS provide additional information on impacts to impaired waters listed under Section 303(d) of the Clean Water Act, analysis of alternative sites, and impacts to subsistence resources and minority populations.

    Final EIS - Gravina Island Timber Sale, Implementation, Timber Harvest and Related Activities, Ketchikan-Misty Fiords Ranger District, Tongass National Forest, AK.
    Summary: The Final EIS responded to EPA's concerns by developing a new alternative that combined helicopter and land-based timber extraction and selecting an alternative that is less damaging to riparian areas and greatly limited road access, protecting deer habitat and intertidal areas which are subsistence resources for native Alaskans. EPA continues to have concerns about the adverse impacts to streams and wetlands, as well as cumulative impacts from roads and access to the roadless area.

    Summary: EPA has environmental concerns about the Preferred Alternative (Alternative F). The Final EIS does not provide sufficient information, data, analyses, or discussion to ensure that all developmental components of the Preferred Alternative will meet the substantive environmental requirements of Clean Water Act Section 404. In addition, EPA has concerns about impacts from current road alignment design, disturbance from access to production pads, the potential for violation of Special Condition 10 of the Corps Permit, erosion from pad sidesloped, lack of specific mitigation measures, and insufficient 9 information regarding air quality impacts.

    Final EIS - Akutan Harbor Navigation Improvements Project, Construction and Implementation, Bering Sea, City of Akutan, AK.
    Summary: EPA agreed with U.S. Army Corps' conclusion that the project would not violate Alaska's water quality standards or exceed the Akutan Harbor TMDL load allocations. However, EPA reiterated objections to the direct and indirect effects on wetlands, and requested that the Corps explore offsite beneficial use options to the stockpiling of dredged material in wetlands. EPA also recommended that the Corps explore compensatory mitigation through wetland enhancements during detailed project design.

    Draft EIS - High Mountains Heli-Skiing (HMH) Project: Issuance of a New 5-Year Special Use Permit (SUP) to....Continue Operating Guided Helicopter Skiing in Portions of the Bridger-Teton National Forest and Caribou-Targhee National Forest Teton and Bonneville Counties, ID
    Summary: EPA expressed environmental concerns regarding impacts to wildlife and reduced likelihood that proposed wilderness areas would be designated as Wilderness.     Draft EIS - East Bridge Cattle Allotment Management Plan Revision (AMP)
    Authorization of Continued Grazing,Caribou-Targhee National Forest, Soda Springs Ranger District, Caribou and Bonneville Counties, ID and Lincoln County, WY.
    Summary: EPA used a screening tool to conduct a limited review of the draft EIS and based upon the screen, does not foresee having any environmental objections to the proposed project.

    Draft EIS - Emerald Creek Garnet Project, Proposal to Mine Garnet Reserves within the St. Maries River Floodplain near Fernwood, Walla Walla District, Issuance of Several Permits, Benewah and Shoshone Counties, ID.
    Summary: EPA expressed concerns over the potential impacts of mining proposals on water quality. EPA recommends that adequate mitigation and reclamation be implemented to move the St. Maries River towards its designated beneficial uses. EPA also expressed concern over alternatives that do not avoid ecologically valuable oxbow complexes and recommended that if an alternative is selected that does not avoid oxbows, additional mitigation measures be implemented to ensure the long-term protection and restoration of wetland functions.

    Draft EIS - Northern Rockies Lynx, Amendment, To Conserve and Promote Recovery of the Canada Lynx, NFS and BLM to Amend Land Resource Management Plans for 18 National Forests, MT, WY, UT and ID.
    Summary:
    EPA expressed concerns that the preferred alternative would allow activities potentially damaging to lynx and its habitat and may not promote adequate conservation to allow lynx recovery. EPA recommended that the involved federal agencies develop standards to better balance lynx conservation and multiple-use needs.

    Draft EIS - Chips AhoyProject, Proposes Vegetation, Wildlife Habitat, Recreation and Aquatic Improvement Treatments, Idaho Panhandle National Forests, Priest Lake Ranger District, Bonner County, ID and Pend Orielle County, WA.
    Summary:
    While EPA has no objection to the proposed action, additional information was requested on recreation activities be included in the Final EIS and that vegetation management in Canada Lynx and Fisher habitat be staggered over time.

    Summary of letter: EPA expressed environmental objections with adverse impacts to water quality under the preferred alternative. Impacts from increased sediment delivery to already impaired surface waters could cause long term exceedances in State Water Quality standards and effects on designated beneficial uses (salmonid rearing). EPA's other concerns included impacts to waters in the Northwest Forest Plan-designated key watersheds, Wild and Scenic Rivers, and potential wilderness values in Inventoried Roadless Areas.

    Draft EIS - WA-35 Columbia River Crossing: Existing Bridge Replacement across the Columbia River between Hood River, OR and White Salmon, WA.
    Summary: EPA has environmental concerns with the proposed project related to air toxics, invasive species, rare plant surveys, and intersection design at the project's northern terminus.     Draft EIS - Corvallis-Newport Highway Improvements: Pioneer Mountain to Eddyville Project on U.S. 20, Lincoln County, OR
    Summary: EPA has environmental concerns with the proposed project regarding the range of alternatives evaluated in the EIS, potential impacts to headwater streams and terrestrial wildlife, and the design of the conceptual mitigation plan. EPA recommends that additional information related to these topics be included in the final EIS, along with information related to wildlife crossings, the disposition of the present highway, and cuts and fills.     Draft EIS - Upper Deschutes Resource Management Plan, Deschutes, Klamath, Jefferson and Cook Counties, OR
    Summary: EPA expressed environmental concerns about ongoing water quality problems on streams in the planning area.     Draft EIS - COB Energy Facility: Construction of a 1,160-megawatt (MW) Natural Gas-Fired and Combined-Cycle Electric Generating Plant, Klamath County, OR
    Summary: EPA raised environmental concerns related to the lack of detailed evaluation of alternatives to the proposed site for the energy generation facility and the route of the proposed transmission line.
