DISCHARGE TO WATERS OF THE UNITED STATES,
and

On June 15, 2004, EPA reissued a National Pollutant Discharge Elimination System (NPDES) permit number AK-002324-8 to the Alyeska Pipeline Service Company. The permit authorizes a discharge from the Valdez Marine Terminal in Valdez, Alaska, pursuant to provisions of the Clean Water Act. The discharge from the facility consists of treated ballast and bilge water and other operational wastes associated with oil storage and transport. Treated sanitary wastes are also discharged. The receiving water is Port Valdez. EPA now proposes to modify the permit to allow Alyeska to use any EPA approved test method for analysis of certain aromatic constituents in the wastewater. The June 2004 permit specified the use of one EPA method for the analysis.

A Fact Sheet and Technical Evaluation, draft modified NPDES permit, and preliminary 401 Certification of Reasonable Assurance are available for review upon request.

Tentative Determination: The Region 10 Office of the EPA has tentatively determined to re-issue a modified wastewater discharge permit to the above listed applicant.

Public Comments on Draft Permit: Persons wishing to comment on the tentative determinations contained in the draft modified permit or wishing to request that a public hearing be held, may do so in writing or electronically, within this public notice period. Comments will be accepted for only those conditions modified by this permit action. All written comments and requests should be submitted to EPA at the above address to the attention of Mike Lidgard, Environmental Engineer. Electronically submitted comments should be sent by e-mail to lidgard.michael@epa.gov. A request for a public hearing shall state the nature of the issues to be raised as well as the requester's name, address and telephone number. Comments must be received by the expiration date of this notice to be considered in the formulation of final determinations regarding the application. All comments should include the name, address and telephone number of the commenter and a concise statement of the exact basis of any comment and the relevant facts upon which it is based.

Public Comments on State Certification: This Notice will also serve as a Public Notice of the intent of the State of Alaska, Department of Environmental Conservation to consider certifying that the subject permit modification will comply with the applicable provisions of Sections 208(e), 301, 302, 303, 306 and 307 of the Clean Water Act. The modified NPDES permit will not be issued until the certification requirements of Section 401 have been met. Persons wishing to comment on State Certification should submit written comments within this public notice period to the State of Alaska, Department of Environmental Conservation (ADEC), Wastewater Discharge Permits Program, 610 University Avenue, Fairbanks, AK 99709.
