NARA Regulations Available for Public Comment

NARA regulations affect the public and Federal agencies. These regulations are contained in the Code of Federal Regulations.

NARA publishes proposed rules in the Federal Register for public comment before changing the regulations.

Proposed rules currently open for comment are:

  • Records Center Facility Standards

    Published: 9/7/04 Federal Register at page 54091.
    Comments due: 11/8/04.

    Summary: NARA proposes to modify its facility standards for records storage facilities that house Federal records to clarify requirements relating to design or certification of multiple story facilities and fire detection and protection systems; to revise certain requirements relating to fire-ratings of roofs, building columns, and fire barrier walls; and to clarify the application of other requirements. We are proposing these changes to address records center industry concerns identified in the 2003 Report to Congress on Costs and Benefits of Federal Regulations. The proposed rule will affect commercial records storage facilities that store Federal records and applies to all agencies, including NARA, that establish and operate records centers, and to agencies that contract for the services of commercial records storage facilities.

  • Records Management; Unscheduled Records

    Published: 9/17/04 Federal Register at page 56015.
    Comments due: 11/16/04.

    Summary: NARA is seeking comments from Federal agencies and the public on a proposed revision to our regulations to allow unscheduled records to be transferred to records storage facilities. These changes would allow agencies to transfer unscheduled records in a timely manner.

  • Presidential Records Act Procedures

    Published: 10/1/04 Federal Register at page 58875.
    Comments due: 11/30/04.

    Summary: In response to a petition for rulemaking, NARA proposes to amend our rules concerning Presidential records to lengthen the time from 10 working days to 35 calendar days to appeal denial of access. This proposed rule will affect the public.

  • Records Management; Electronic Mail; Electronic Records; Disposition of Records

    Published: 11/3/04 Federal Register at page 63980.
    Comments due: 1/3/05.

    Summary: NARA has published a proposed rule and is seeking comments from Federal agencies and the public on a proposed revision to our regulations to provide for the appropriate management and disposition of very short-term temporary e-mail, by allowing agencies to manage these records within the e-mail system.
