Portland, Maine, ozone maintenance plan

On September 17, 2002, EPA published a notice of proposed rulemaking in the Federal Register, proposing to redesignate the Portland, Maine moderate ozone nonattainment area to maintenance. In this notice, EPA also proposes to approve the maintenance plan and the1999 maintenance inventory for the Portland Area. Concurrent with the public comment on the notice of proposed rulemaking, EPA is also taking public comment on the
adequacy review of the motor vehicle emissions budgets identified in the Portland Area's maintenance SIP. September 17, 2002.

As of the date of this posting, the State of New York had submitted a proposed SIP revision to EPA but had not yet formally submitted the final revision. However, the State has requested that EPA parallel process the proposed SIP revision for adequacy, meaning that we will start the public comment period for the adequacy of the SIP prior to the State completing its SIP adoption process. As in every adequacy review, the public has 30 days to comment on the adequacy of this SIP. Should there by any significant changes to the SIP when the State formally submits the final version to EPA, we will restart the 30 day public comment period for adequacy. However, if the State submits the current proposed SIP as the final version to EPA, there will not be another comment period before EPA makes its adequacy finding.

Weirton, West Virginia, PM10 maintenance plan

On November 9, 2004, EPA published a notice in the Federal Register that corrects an omission in the preamble language of the October 27, 2004, direct final rule that approves the redesignation of attainment and maintenance plan for the Weirton, West Virginia, PM10 nonattainment area. This correction notice explains why PM10 motor vehicle emissions budgets, for purposes of transportation conformity, are not required to be part of the maintenance plan for the area.
On October 27, 2004, EPA published a proposed and direct final rule in the Federal Register approving a maintenance plan for the Weirton, West Virginia, PM-10 area. EPA's adequacy review and an opportunity for public comment on the maintenance plan are concurrent. This rule is effective on December 27, 2004, unless EPA receives written comments by November 26, 2004. If adverse comments are received, EPA will publish a notice in the Federal Register withdrawing the rule and informing the public that the rule will not take effect.
