SUBJECT:    Delegation of Authority Relating to the Payment of Amounts Based on Certain Anti-Terrorism Judgments

1.  DEFINITION

The term “Section 2002,” as it is used in this order, means section 2002 of the Victims of Trafficking and Violence Protection Act of 2000, Public Law 106-386, as amended by: section 686 of the Foreign Relations Authorization Act, Fiscal Year 2003, P.L. 107-228; section 201 of the Terrorism Risk Insurance Act of 2002, P.L. 107-297; and as may be amended in the future.

2.  DELEGATION OF AUTHORITY

By virtue of the authority vested in the Secretary of the Treasury, including the authority in 31 U.S.C. 321(b), it is hereby ordered as follows:

     a.    Except to the extent set forth in section 2.b below, I delegate to the Director of the Office of Foreign Assets Control all authority and responsibility vested in the Secretary of the Treasury by Section 2002, including, but not limited to, any pro rata distribution determination; and 

     b.    I delegate to the Commissioner of the Financial Management Service the authority and responsibility vested in the Secretary of the Treasury by Section 2002 to perform all functions necessary for authorizing, including certifying, the payments and disbursing the payments on complying applications for payments that are required to be made, pursuant to Section 2002, from the source of funds described in Section 2002(b)(2)(B).

3.  REDELEGATION

  a.    The authorities and responsibilities of the Director of the Office of Foreign Assets Control in section 2.a of this order may be redelegated in writing to an appropriate subordinate official, or may be carried out by offices under the Director pursuant to general delegations and arrangements.

      b.   The authorities and responsibilities of the Commissioner of the Financial                          Management Service in section 2.b may be redelegated in writing to an appropriate subordinate official, or may be carried out by offices under the Commissioner pursuant to general delegations and arrangements. 

4.  CANCELLATION

This order supersedes Treasury Order No. 105-14, “Delegation of Authority Relating to the Payment of Amounts Based on Certain Anti-Terrorism Judgments,” dated December 21, 2000.  This order does not affect the validity of actions taken under Treasury Order No. 105-14 of December 21, 2000.
