The U.S. Department of Labor today announced the continuation of probation for Guess? Inc., the Los Angeles-based clothing company, on the department's Trendsetter List--a directory of apparel retailers and manufacturers that take additional steps to ensure their goods are not made under sweatshop conditions. The probation will continue until further notice.

"Since November 27, when the department placed Guess? Inc. on probation, the company has informed us that they are taking steps to address the flaws identified in its domestic monitoring program. We are encouraged by this effort. However, the department has become aware through media reports that Guess? plans to move a significant portion of its manufacturing to contractors in Mexico and other foreign locations. We are requesting a clarification of these issues--including information regarding how Guess? plans to assure that its international contractors comply with applicable work standards--before a final decision is made," said Maria Echaveste, administrator of the department's Wage and Hour division.

The department's Trendsetter List is based on information provided by apparel companies about their voluntary efforts to ensure that their goods are made in compliance with labor laws. To be a Trendsetter, companies must: demonstrate a commitment to labor laws; cooperate with law enforcement agencies when violations are found; educate suppliers regarding the Fair Labor Standards Act; and regularly monitor their cutting and sewing contractors and subcontractors. Thirty-one companies--representing more than 115 apparel lines and thousands of retail stores across the country--are listed.
