WASHINGTON - Tammy D. McCutchen, senior counsel at Hershey Foods
Corp., has been nominated to serve as administrator of the U.S. Department of
Labor Employment Standards Administration Wage and Hour Division. McCutchen's
nomination has been sent to the Senate Health, Education, Labor and Pensions
Committee.
"Tammy will bring a tremendous amount of experience to the Wage and Hour
Division," U.S. Secretary of Labor Elaine L. Chao said. "Her knowledge of Labor
Department programs will make her a great asset to working Americans."
As senior counsel for Hershey Foods Corp., McCutchen has provided
counseling on labor and employment matters involving Hershey's 15,000 employees
at corporate offices, Hershey International, twenty field offices and 22
manufacturing plants in the United States, Canada and Mexico. She has
wide-ranging experience dealing with laws affecting American workers such as
the Americans With Disabilities Act, the Fair Labor Standards Act and the
Family and Medical Leave Act. McCutchen has managed employment-related
litigation before state and federal courts, the Equal Employment Opportunity
Commission and state agencies.
McCutchen has managed the preparation and implementation of Hershey
Foods Corporation's 22 Affirmative Action plans, provided assistance to
Hershey's Diversity Counsel and conducted training for managers on recognizing
and responding to discriminatory harassment. She has also advised the
corporation on collective bargaining and labor arbitration issues.
Prior to her career at Hershey Foods, McCutchen was an associate
attorney at the Chicago law firms of Matkov, Salzman, Madoff & Gunn and
Skadden, Arps, Slate, Meagher & Flom. She was born in Cambridge, Ill., and
graduated summa cum laude from Western Illinois University with a B.A. in
English literature. She earned her law degree from the Northwestern University
School of Law, where she graduated cum laude and Order of the Coif. manage
