Introduction

Welcome to the Consular Section of the American Embassy in Suva, Fiji. We are the largest consular section in the world serving Fiji, Tonga, Tuvalu, Nauru, French Polynesia, Wallis & Futuna and Kiribati. The section is divided in to three separate units:American Citizen Services Unit: offers a broad range of services to American Citizens in Fiji, Tonga, Nauru, French Polynesia, Tuvalu or Kiribati. These services include protecting Americans abroad, issuing passports, and facilitating absentee voting and other traditional governmental functions, such as Federal Benefits.

Americans living or traveling abroad to these countries should register with the embassy. Through registration, the Embassy can know more accurately the number and location of American citizens in the event that an emergency situation necessitates the rapid dissemination of vital information.

For the most recent State Department travel information on any country, you may review the consular information sheets. On these countries you may wish to review the State Department Bureau of Consular Affairs website. Non-Immigrant Visa Unit processes visas for people traveling to the United States for a holiday, for business purposes, or to study in the U.S.Immigrant Visa Unit processes visas for the spouses or other dependents of American Citizens, as well as other qualified persons, who wish to live permanently in the United States.

Transit time for international mail to the Embassy is about 3-4 weeks. Should you have an emergency and need Embassy assistance, please call the Embassy at any time and the on-call officer will be contacted.

American Citizen Services

We assist American citizens in our consular district, including passport services, notarials, registration, Consular Reports of Birth Abroad, documentation for marriage, voting in U.S. elections, various federal benefits and more. In addition, ACS assists U.S. citizens in emergency situations including arrests, deaths, and crisis.

If an American citizen is involved in a serious accident, is distressed, or dies, please call our 24-hour number (679) 3314-466 or ask for the Duty Officer.The ACS unit is open Monday through Friday from 8 a.m. to 4 p.m. We are closed on American and Fijian holidays.

The following instructions outline the necessary steps for obtaining a new passport.

1. Complete the Application form DSP-11. Please be sure to answer ALL questions and indicate which questions are not applicable to you. The form should be signed by the applicant if 14 years and above. Children under age 14 require both parents' signatures, and must sign in the presence of an American Consular Officer. Incomplete submissions will delay passport issuance.

2. First time (minor or adult) U.S. passport applicants, renewals under 16 years of age, and applicants who are unable to present previously issued passports due to theft or loss must sign in the presence of an American Consular Officer. You can either apply in person at the American Embassy in Suva, or wait for a Consular visit to your country. United States laws require applicants using Form DSP-11 (Brown Form) to execute the application under oath before a person authorized by the Secretary of State to administer oaths for passport purposes. Applicants using Form DSP-11 cannot execute the application before a Court Magistrate in Tonga, Tuvalu, Nauru, Kiribati or before a Notaire in the French Territories.

3. Procedures for renewals of existing passports using DSP-82 (Pink Form) remain unaffected. These may be mailed to the Consular Section at 31 Loftus Street, P.O. Box 218, Suva or personally brought in (8:30 – 11:30 A.M. or 2:00 – 4:00 P.M.) along with:

(a) The previous passport of each applicant. If you have never had a U.S. passport, or your passport is lost or stolen, you must provide evidence of your U.S. citizenship, e.g. a birth certificate or Consular Report of Birth Abroad or a photocopy of your lost passport. Documents must be originals or certified true copies.

(b) Three (3) passport photos. Your photographs must be 2x2 inches in size on a white background, identical, taken within the past 6 months, showing current appearance.

(c) Fees – See below.

FEES: A bank draft (certified check) payable to: “U.S. Embassy” in U.S. dollars and drawn on a bank located in the U.S. Cash in U.S. dollars or the equivalent in Fiji dollars also accepted. Personal Checks are Not Accepted.

**Execution fee is required of first-time (minor or adult) applicants, renewals under 16 years of age and applicants who are unable to present previously issued passports due to theft or loss.

Application for the replacement of a lost/stolen passport please submit:

  • Form DSP-11 which is an application for a U.S. passport
  • Police Report-report of the loss to the police station nearest to where you lost your passport. An affidavit of loss/stolen passport form must also be completed at the Embassy.
  • Proof of U.S. Citizenship-birth certificate, Consular Report of Birth Abroad, or Naturalization certificate.
  • Proof of Identity -driver's license, military I.D., etc.
  • Three passport photographs-size 2'x2' or 5 cm x 5 cm with light background
  • Application fee US$70.00 (Age 15 or below), US$85.00 (Age 16 or above). We accept Fiji or US dollars.
  • All applicants must appear in person.

Amendment of passports can be performed at the request of the bearer to show a married name or legal change of name. An Application for Amendment/Extension of passport (DSP-19) is used. Legal or formal support documentation must be presented. Emergency passports can be issued to individuals who are American citizens but are unable to present the necessary documentary proof of citizenship.

Register a Birth

Complete all items on the enclosed Application for Consular Report of Birth Abroad, and Affidavit of Parentage & Physical Presence. The forms should be signed in the presence of an American Consular Officer. In the absence of a Consular Officer you may sign the application and affidavit before a Notary Public or other official authorized to administer oaths. The notary/official should affix his seal, signature and date in the appropriate spaces on the application for Consular Report of Birth Abroad Form (Page 1, Section B, Number 16) and Page 2 of the Affidavit of Parentage and Physical Presence. Please provide full dates describing when you, the parents, have lived in the U.S. and when you have lived outside the U.S. or its territories. Complete all items on the form for both you and your spouse, leaving no blanks. The following documents are to be mailed (if you live outside Fiji) or presented in person to the Embassy:

  • Children’s original birth certificate
  • Evidence of parents’ U.S. citizenship (passport, birth & naturalization certificates)
  • Parents’ original marriage certificate
  • Evidence of termination of any prior marriage(s)
  • A fee of US$65.00 either in cash or cashier’s check, payable to the American Embassy and drawn on a bank located in the United States. PERSONAL CHECKS WILL NOT BE ACCEPTED
  • An Affidavit of Parentage/Physical Presence (link) must be completed by the citizen parent(s). If any of the above documents are not in the English language, they must be accompanied by certified translations.

Upon receipt of all of the above, the Embassy will evaluate all the information submitted, and if you are qualified to transmit citizenship to your child/children, a Certification of Birth of an American citizen will be issued and sent to you together with the originals of all documents submitted. If you wish to apply for your child’s/children’s U.S. passport/s at the same time that you apply for the Report/s of Birth, please complete the BROWN passport application (form DSP-11) (link to on your child’s/children’s behalf, following all instructions provided and including the necessary fee.

The ACS Unit does accept SSA and Benefit checks on the behalf of Americans living in our Consular District.

Tax Information

The ACS unit keeps commonly used IRS forms and booklets for the convenience of American Citizens in our consular district or you can contact the IRS (www.irs.ustreas.gov/prod/cover.html) electronically for tax forms. Additional information is also available on the consular affairs website (link to http://travel.state.gov/fed-benefits.html#taxes.)

The IRS wants you to know that you must file annual income tax returns and report income from all sources, both inside and outside the U.S. If you have not filed tax returns recently, the IRS can help bring your accounts up to date. Taxpayers who come forward and make a true, voluntary disclosure and file an accurate return will not be prosecuted. Voting Information

U.S. Law authorizes qualified citizens residing abroad to register and vote by absentee ballot in their state of last residence. Voting Officers at US Embassies and Consulates provide information on the voting processes and will help you with complying with your home state's laws. Americans do not actually vote at Embassies and Consulates. The electoral process is administered by the states and you vote by mailing an absentee ballot to your home state.

For official information on voting overseas, the Voting Assistance Guide is available at the Embassy. It has instructions on filling out the federal forms, gives suggestions on how to determine the state in which you should vote, and summarizes state regulations on how to register and request ballots.

Immigrant Visas

Immigrant visas are for persons who are immigrating to the U.S. -that is persons who plan to live, work or study and remain permanently in the United States.

The Immigrant Visa section is open for pre-arranged interviews from 8:30 am to 1:00 pm Monday, Tuesday, Thursday, and Friday. The Section is open for telephone inquires from 2:00 pm-4:00 p.m., Monday through Friday. Please call 331-4466 for IV information during these times only. General Categories of Immigrants:

Persons immigrating to the United States are divided by U.S. immigration law into two general categories:
1. Those who may obtain legal permanent residence status without numerical limitation ("immediate relatives"); and
2. Those who are restricted by an annual limitation on the number of persons who may enter as permanent residents ("preference cases").

Immigrants not Numerically Limited

Immediate Relatives of United States Citizens- The spouse and minor unmarried children of a United States citizen, and the parents of a United States citizen who is over the age of 21.

Returning Residents - Immigrants who lived in the United States previously as lawful permanent residents and are returning to live in the U.S. after a temporary visit of more than one year abroad.

Immigrants Subject to Numerical Limitations

Family-Based Immigrants

  • 1st preference: Unmarried sons and daughters if U.S. citizens
  • 2nd preference: Spouses, children, and unmarried sons and daughters of lawful permanent resident aliens
  • 3rd Married sons and daughters of U.S. citizens and their spouses and children
  • 4th Brothers and sisters of United States Citizens, provided the U.S. citizens are 21 years of age of over.

Employment-Based Immigrants

Diversity Lottery Immigrants: Such immigrants are identified by random selection each year by the Secretary of State from among persons who submit applications during a specified period. Applicants for diversity immigrant status must have a high school education or two years of recent work experience in a skilled job.

Applying for an Immigrant Visa

In general, any applicant for an immigrant visa must be the beneficiary of an approved petition. Applicants for family-sponsored immigrant visas who believe they are entitled to immigrant status based on a relationship to a United States citizen or lawful resident alien should request that relative file a petition (Form I-130) with the nearest Bureau of Citizenship & Immigration Service Office in the United States. The fee to file this form is US$130.00 for a local petition. In some cases if the American Citizen sponsor is residing abroad, he or she may file the petition with the consular officer at the U.S. Embassy. For DV-2005 Diversity Visa Lottery Program, entries are free of charge. Entries however must be submiitted electronically to the Department of State during the 60 day registration period begining Saturday, November 1, 2003 to Tuesday, December 30, 2003 at www.dvlottery.state.gov . Information materials must be obtained at the Embassy at 31 Loftus Street Suva, or by accessing the Internet webstie at http://travel.state.gov .

Persons Ineligible to Receive Visas

In order to protect the health, welfare, and security of the United States, immigration laws prohibit the issuance of a visa to certain applicants. Examples of applicants who must be refused visas are those who:

  • Have a communicable disease such as tuberculosis, or have a dangerous physical or mental disorder, or are drug addicts;
  • Have committed serious criminal acts including crimes involving moral turpitude, drug trafficking, and prostitution; or
  • Are likely to become public charges in the United States.

Documents Required in Support of a Visa Application

All applicants must submit certain personal documents such as passports, original birth certificates, original marriage certificates, police clearance reports, and a medical report. In addition, all applicants must present evidence that they will not become a public charge in the United States. The consular officer will inform visa applicants of the documents needed as their applications are processed.

Lost/Stolen or nonreceipt of Green Cards

Lost/Stolen or nonreceipt of green card applications must be handled during normal business hours. Legal permanent residents who have lost their cards MUST call the Immigrant Visa Unit on 331-4466 to schedule an appointment. The fee for the transportation letter is US$300.

Non-immigrant Visas

If you are interested in travelling to the United States for a definite amount of time for business, pleasure, or to study, you will need a non-immigrant visa.

Ties to your home country that encourage your return following your visit and proof of financial resources to demonstrate that you will not work in the United States are the most important considerations in visa applications.

The Non-Immigrant Visa Unit is open for interviews from 8:30 a.m. to 11:30 a.m., Monday through Friday, with the exception of Wednesdays. It is now necessary to schedule an appointment for your interview with the Consular Officer. To do so, please call 330-6243 from 2-4 p.m. Monday through Friday. You can fill out a form online by going to http://evisaforms.state.gov. Bringing the electronic application with you to the Embassy will reduce time. For general information regarding visas, please call 330-3888.

Please note the following:All documents must be available at the time of interview. Do NOT send documents directly to the Embassy.

The fee to lodge an application for a non-immigrant visa is US$100.00 and must be paid at the Embassy or pay FDJ $180 at a Post Fiji outlet before the interview. Additional charges may apply. Please complete all questions and sign the DS0156 application form (travel.state.gov/visaforms.html) for a non-immigrant visa and include a recent photograph for each applicant. Tourist visas are issued according to United States law. You cannot work in the U.S. with a tourist visa. You must prove strong economic and family ties that would encourage you to return to your home country. You must also prove that you have financial resources to support yourself in the U.S. without working illegally. A letter of support from a sponsor will not prove your ties. Documents that help to show your ties are:

Letter from your employer showing time on the job, earnings, and period of leave;
Evidence of funds in the form of monthly bank statements showing transactions made over a six-month period-we do not accept one-off statements;
Documents detailing ownership of business, property, automobile, or other assets.

Presentation of a given set of documents does not guarantee the issuance of a visa.

We advise you not to request an interview if you have applied and been refused in the past six (6) months.

Do not bring birth or marriage certificates when applying for a tourist visa.
Your passport must be valid for at least six months past your travel date.
You must use courier return service. Pre-paid envelopes are available at Post Fiji.
All applicants for student visas must have an original, signed, sealed and complete I-20 form from the school, evidence to show sufficient funds for support, and school grades/reports/external exam results, tertiary or college transcripts and/or equivalent academic records;If you meet one of the following requirements, your application will qualify for our Drop Box:

  • US valid visa which needs to be transferred to a new passport;
  • Diplomat with a diplomatic note;
  • Member of the Fijian Military (Lieutenant or above) with valid leave/travel orders;
  • Seaman with a previous C-1/D visa and a letter from a recognized shipping agency;
  • Member of an airline crew serving on U.S. bound flights from Fiji with a letter of employment;
  • Applicant for a J-1 visa going on an U.S. government ("G") program with a valid DS-2019;
  • A child 16 years of age or under;
  • A person 60 years of age or older;
  • Applicants for diplomatic or official visas, with covering diplomatic note or letter;
  • Applicants who, within twelve months of the expiration of a previously issued visa, are seeking re-issuance of a non-immigrant visa in the same classification at the Consular Post of their usual residence, and for whom the Consular Officer has no indication of visa ineligibility or noncompliance with U.S immigration laws and regulations.

Visa Waiver Program

The Visa Waiver Program (VWP) enables citizens of certain countries to travel to the United States for tourism or business for 90 days or less without obtaining a visa. Not all countries participate in the VWP. Some restrictions apply to this program as explained below.

NOTE: Representatives of the foreign press, radio, film, journalists or other information media, engaging in that vocation while in the U.S., require a nonimmigrant Media (I) visa cannot travel to the U.S. on the visa waiver program and cannot travel using a visitor visa, seeking admission by the DHS immigration inspector, at the U.S. at the port of entry.

What Are the Visa Waiver Program (VWP) Countries?

Currently, 27 countries participate in the Visa Waiver Program, as shown below:

Note: Countries in bold above with the (MRP) designation are required to have machine-readable passports (MRP) as of October 1, 2003 for travelers to enter the U.S on the visa waiver program. All other countries visa waiver program travelers above must have a MRP as of October 26, 2004 except Belgium, which has had an MRP requirement for VWP travelers since May 15, 2003.

What I Need to Know about VWP & the Required Machine Readable Passport?

The Secretary of State, working with the Department of Homeland Security, has granted a postponement until October 26, 2004, as the date by which visa waiver program travelers from 21 countries must present a machine-readable passport at a U.S. port of entry to be admitted to the United States without a visa. Five countries will continue with the October 1, 2003 deadline. The Patriot Act legislated the machine-readable passport requirement for visa waiver program travelers and additionally gave the Secretary of State authority to postpone the effective date.

  • Countries With an October 1, 2003 MRP Date - Four visa waiver program countries, specifically Andorra, Brunei, Liechtenstein, and Slovenia, did not request a postponement of the machine-readable passport effective date, because all or virtually all of their citizens already have machine-readable passports.
    As of October 1, 2003, visa waiver travelers from Andorra, Brunei, Liechtenstein, and Slovenia must present either a machine-readable passport (MRP) or a U.S. visa at the port of entry to enter the U.S. This includes all categories of passports -- regular, diplomatic, and official, when the traveler is seeking to enter the U.S. for business or tourist purposes, for a maximum of 90 days without needing a visa.
  • Countries With a October 26, 2004 MRP Date - Travelers from countries granted the postponement can continue to travel, as they have in the past, without a machine-readable passport. On October 26, 2004 a machine-readable passport or U.S. visa will be required at the port of entry, to enter the U.S. without a visa. Countries with the machine-readable passport postponement until October 26, 2004 are:
    Australia, Austria, Denmark, Finland, France, Germany, Iceland, Ireland, Italy, Japan, Luxembourg, Monaco, Netherlands, New Zealand, Norway, Portugal, San Marino, Singapore, Spain, Sweden, Switzerland, and the United Kingdom.
  • Belgium, which is also a visa waiver country, was not eligible to receive this extension. Belgian nationals who wish to travel under the visa waiver program have been required to present a machine-readable passport since May 15, 2003.

What Is a Machine Readable Passport?

A machine readable passport has biographical data entered on the data page according to international specifications. The size of the passport and photograph, and arrangement of data fields, especially the two lines of printed OCR-B machine readable data, meet the standards of the International Civil Aviation Organization, Doc 9303, Part 1 Machine Readable Passports. OCR-B means the type is Optical Character Reader size B. If there are questions about your passport, after carefully reviewing this information, and any information which may be available to you from your country, you may want to contact the passport issuing agency or authority in your country of citizenship.

What Should I Know About Machine-Readable Passports and Families?

Families seeking to enter the U.S. under the VWP will need to obtain an individual passport for each traveler, including infants. Machine-readable passports typically have biodata for only one traveler in the machine-readable zone. Based on this, families may be denied visa-free entry into the U.S. if the biodata for only one traveler is machine-readable.

What Do I Need to Enter the United States under the VWP?

To enter the U.S. under the VWP, travelers from participating countries must:

  • Be a citizen of a Visa Waiver Program country;
  • Have a valid passport issued by the participating country that is valid for six months beyond your intended visit;
  • Have a machine-readable passport (MRP), following the required due dates for MRPs explained above;
  • Be seeking entry for 90 days or less, as a temporary visitor for business or pleasure. You will not be permitted to extend your visit or change to another visa category under the VWP.

Visitors for Business - Here are types of activities permitted as a business visitor:

  • Participating in commercial business transactions which do not involve gainful employment in the U.S, for example, negotiating contracts or consulting with business associates You cannot receive a salary or wages from a U.S. source.
  • Participating in scientific, educational, professional or business conventions, conferences or seminars;
  • Conducting independent research;
  • Appearing as a witness in a court trial.

Visitors for Pleasure - While this is not a complete listing, here are types of activities permitted:

  • Visiting friends and relatives, touring or vacationing, visits for rest;
  • Visits for medical treatment.
  • Participating in conventions, conferences or convocation of fraternal or social organizations;
  • Amateurs participating in sports, musical, and other events or contests, who will receive no money or other remuneration in return.

If entering by air or sea, have a round-trip transportation ticket issued on a carrier that has signed an agreement with the U.S. government to participate in the VWP, and arrive in the United States aboard such a carrier.

Hold a completed and signed Nonimmigrant Visa Waiver Arrival-Departure Record, Form I-94W, on which he/she has waived the right of review or appeal of an immigration officer’s determination about admissibility, or deportation. These forms are available from participating carriers, from travel agents, and at land-border ports-of-entry.

You must have no visa ineligibilities. This means if you have been refused a visa before, have a criminal record or are ineligible for a visa you cannot travel on the Visa Waiver Program without a visa. You must apply for a visa to the U.S.

Entry at a land border crossing point from Canada or Mexico is permitted under the Visa Waiver Program.

Is there Any Fee?

When Does a Citizen of a VWP Country Need to Apply for a Visa?

You must apply for a visa under the following circumstances, if you:

Do Canadian Citizens Need a Visa or MRP?

Citizens of Canada generally do not require a visa. (While some people mistakenly think Canada is part of the visa waiver program, the authorization for Canadian citizens to travel visa-free comes from other immigration laws.) The machine-readable passport requirement does not apply to Canadian citizens, because they are not part of the visa waiver program. It should be noted, these Canadian citizens travelling to the US require nonimmigrant visas: treaty traders (E), and fiance/es (K-1), as well as a U.S. citizen's foreign citizen spouse, who is traveling to the U.S. to reside here while they wait for the final completion of the process of immigration (K-3), and their respective children (K-2 for children of fiancees, and K-4 for children of a foreign citizen spouse), spouses of lawful permanent residents (V-1) and the children of those spouses (V-2) traveling to the U.S. to reside here while they wait for the final completion of their immigration process. Additionally, these Canadian citizens travelling to the US require nonimmigrant visas: foreign government officials (A), officials and employees of international organizations (G), NATO officials, representatives and employees if they are being assigned to the U.S. (as opposed to an official trip). Machine Readable Passports Needed by Visa Waiver Program Travellers

Starting October 1, 2003, travelers entering the United States under the Visa Waiver Program must have a machine-readable passport. Any traveler without a machine-readable passport will be required to obtain a visa before coming to the United States.

Immigration inspectors may deny entry to any traveler attempting to enter on a visa-waiver basis without a machine-readable passport after October 1, 2003.

Countries participating in the Visa Waiver Program have long been required to have a program for the issuance of machine-readable passports, but after October 1, 2003, use of such a passport is mandatory for visa-free entry for both adults and children. Citizens of Belgium have been required to present a machine-readable passport for visa-waiver entry since May 15, 2003.

Citizens of Visa Waiver Program countries are permitted to enter the United States for general business or tourist purposes for a maximum of 90 days without needing a visa. The Visa Waiver Program requirements can be found at the Department of State's Visa Services web site, http://travel.state.gov/vwp.html.

A machine-readable passport can generally be identified by the presence of two typeface lines printed at the bottom of the biographical page that can be read by machine. These lines can be scanned at entry and exit points to verify the passport data. The machine-readable passport requirement applies to all categories of passport: regular, official or diplomatic. If travelers have any doubt about whether a passport qualifies as machine-readable, they should check with their country’s passport issuing authority.

A traveler who uses a non-machine-readable passport, even if from a Visa Waiver Program country, will have to apply for a non-immigrant visa at a U.S. Embassy or Consulate. The worldwide US-visa application fee is US $100.

Internet Applications of US Visas

Visa applicants who wish to reduce the time required to obtain a nonimmigrant visa at the U.S. in Suva can do so by completing a visa application form on the Internet, printing it, and bringing it to the Embassy when they apply.

Handwritten and typed visa application forms (DS-156) will still be accepted. However, presenting a properly completed Internet form will reduce the time spent waiting for an interview as this will allow the Embassy’s staff to scan the information on the form directly into our data base, rather than having to do manually. As a result, applicants who provide Internet applications will generally be interviewed ahead of those presenting handwritten or typed forms.

Medical facilities (hospitals, clinics, and pharmacies) are good on Tahiti and the other major islands, but they are more limited in the more remote on less populated islands. You should be able to find a pharmacy or clinic for basic medical care on most islands, but for anything more serious, you will need to be evacuated to one of the main islands or to a regional center.

The fee for a medical consultation is about 3000 CFP, although this can go as high as 7000 CFP at night or on Sunday; fees are less at Mamao public hospital. French visitors can get the fee refunded when they return home through a reciprocal agreement; citizens of the EU should obtain a form E111 before leaving home.
