(US equivalent of ATTORNEYS) - none of whom are Notary Publics
Both barristers and solicitors
provide legal advice, draft contracts and may represent a client in
disciplinary counsels, general
assemblies and negotiations. Solicitors
draft plaints, summons,
affidavits and may present before
all courts in Mauritius, except the Intermediary and Supreme
Courts. Barristers have the right of audience before all courts on the
island; they plead and advocate
cases. Most barristers in Mauritius have solicitors at their service who
instruct them and bring clients
to court. The solicitor may appear without a
barrister, if the client has decided not to have one, in
cases that are not presented
before the Intermediary and Supreme Courts.
The services of a solicitor
to instruct a barrister are not
compulsory because this is done by the Public Prosecution Office.
