CONSULATE'S POLICY ON ATTORNEYS ACCOMPANYING CLIENTS TO SCHEDULED INTERVIEWS

The category "Professionals Under the North American Free Trade Agreement" is available only to citizens of Mexico and Canada. Under the North American Free Trade Agreement (NAFTA) a citizen of a NAFTA country may work in a professional occupation in another NAFTA country provided that 1) the profession is on the NAFTA list, 2) the alien possesses the specific criteria for that profession, 3) the prospective position requires someone in that professional capacity and 4) the alien is going to work for a U.S. employer. The spouse and unmarried, minor children of the principal alien are entitled to the derivative status, but they are unable to accept employment in the United States. Aliens entering under this classification are considered non-immigrants. See NAFTA Professional Job Series List at the end of this page.

 

TN NAFTA VISA APPLICATION INSTRUCTIONS FOR THE U.S. CONSULATE IN JUAREZ

If you reside in our consular district and wish to apply for a TN Professional Visa you need to submit an application package in advance to the above address.The package should consist of the following:

  1. Employment Offer Letter (see below)
  2. Copies of your degrees, diplomas, certificates of completion and other documents related to your credentials and qualifications.You will be required to present the originals on the date of the interview.
  3. Receipt for a USD $100 visa-processing fee paid at BANAMEX, or if in the U.S., a U.S. Postal Money order payable to the U.S. Treasury.
  4. DS-156, Application for Nonimmigrant Visa.For male applicants age 16 to 45, DS-157, Supplemental Application for Nonimmigrant Visa is also required.
  5. Two frontal view, 2 x 2 inch photos on white background.

The application package may be mailed to our U.S. P.O. Box or to our address in Ciudad Juarez, Mexico.

A preview of your application is required regardless of what method you use to submit it. You will not be interviewed on the day that your application is received. After we have completed the review we will contact you and make arrangements for an appointment. Please allow up to four weeks processing time.

Spouses and children of TN applicants will not submit application forms or fees in advance.They will do so at the time of the scheduled interview.

THE OFFER OF EMPLOYMENT LETTER MUST INCLUDE INFORMATION AND EVIDENCE REGARDING ALL OF THE FOLLOWING:

A.Requesting Employer

  • Name of company, type of business (sales, manufacturing, services, etc.)
  • Address, telephone no., web site, E-mail address
  • Legal entity (corporation, Limited Liability Company, Limited Liability Partnership, Partnership, Sole Proprietorship-submit legal document)
  • Office or authority that processes personnel actions
  • Year established
  • Name of parent company, partners, or proprietor
  • Other affiliates or subsidiaries
  • IRS Tax No.
  • Gross and net annual income for last tax year
  • No. of employees
  • Business Income Tax Returns for the three most recent tax years
  • Substantiating evidence of the business’ marketing, promotional activities and its customer base

B.  Applicant’s Credentials/Qualifications

  • Applicant’s Name (include first, middle, paternal last, maternal last names)
  • Date and place of birth
  • Nationality (copy of passport)
  • Copies of prior visas (all classifications)
  • Profession
  • Type of Degree and field of study (include copy of degrees, diplomas, certificates of completion; and accreditation of foreign academics and credentials by a recognized evaluation service)
  • Education and Experience Vitae/Membership in Professional Organizations, Licenses (describe fully-separate sheets may be required)

C.  Proposed Employment

  • Job Title
  • Qualifying profession in which the applicant will be engaging (from the NAFTA Professional Job Series List)
  • Detailed description of proposed employment
  • Location of proposed employment
  • Full or Part-time (specify no. of hours per week)
  • Proposed wages per hour/week
  • Justification for employee with applicant’s profession and duration of proposed employment (explain justification)
  • Type of licensure required for proposed employment  (note: compliance enforcement is the responsibility of local or state authority and lack of licensure is not a basis for visa refusal)
  • G-28, Notice of Entry of Appearance as Attorney or Representative (if applicable)

NOTE:   The requesting employer should provide supporting documentation for the information included in the employment letter whenever practical.  Incomplete information or lack of evidence may delay completion of the review or the refusal of the application.  We may request other evidence as deemed necessary.

ADDITIONAL INFORMATION

Option for TN Classification for Canadian Citizens:  Canadian citizens can request TN certification at the port-of-entry in lieu of obtaining a visa.  They need to present an employment offer letter from his/her prospective U.S.-based employer and pay a U.S. $50.00 fee at the port-of-entry.

 

Non-Canadian and Non-Mexican Derivative Applicants:  Qualifying family members possessing either Mexican or Canadian citizenship will be issued multiple entry TD visas valid for the maximum period authorized for the principal alien.  Non-Canadian or Non-Mexican qualifying family members of TN status holders are also entitled to TD visas, which can be issued in non-Canadian or non-Mexican passports.

 

Extension of Stay:  A citizen of Canada or Mexico admitted pursuant to NAFTA may seek an extension of stay as a TN through the filing of a Form I-129 by the U.S. employer or U.S. entity (in case of a TN who has a foreign employer) with the Nebraska Service Center.  No labor certification requirements apply to an alien in TN status who is seeking to extend that status as the Form I-129 is considered an application for extension of stay rather than a petition in this case.  The applicant must be in the U.S. at the time of filing the extension request.  Provision is made for port-of-entry or consular notification should the applicant depart the U.S. during the processing of the application.  An extension may be granted for up to one year.

A citizen of Canada or Mexico is not precluded from departing the U.S. and applying for admission with documentation from a U.S. employer (or foreign employer, in the case of an alien who is seeking to provide prearranged services at a professional level to a U.S. entity) which specifies that the applicant will be employed in the U.S. for an additional period of time.  The evidentiary requirements must be met by the applicant and, in the case of a Canadian citizen, the prescribed fee must be remitted upon admission.  In the case of a Mexican citizen, the passport and visa requirements also apply.

 

Visa Renewal Applications:Renewal applications will require a re-examination of the employer’s qualifications.They will not be automatically approved solely on the basis of the prior visa.  A continuing employment letter with updated supporting documentation will be required.
