Amended title 37 regulations

Attention Compulsory Licensees:

This is to notify you that on June 22, 2004, the Copyright Office of the Library of Congress published in the Federal Register amended regulations governing the content and service of the Notices of Intention that must be served on the copyright owner of a musical work in the case where the licensee expects to make and distribute phonorecords pursuant to the section 115 statutory license.

The amended regulations, sections 201.18 and 201.19 of Title 37 of the Federal Code of Regulations, went into effect on July 22, 2004, and, among other things, they allow a licensee, under certain circumstances, to:

  • list multiple works on a single notice (although a separate filing fee is still required for each musical work),
  • use a copyright owner’s address other than the one listed in the Copyright Office records, and
  • serve a Notice of Intention on a copyright owner or an authorized agent of the owner.

In addition to the sample changes mentioned above, a Certificate of Filing will no longer be available. However, if certification of a document is what you require, you may consult Circular 6 - Access to and Copies of Copyright Records and Deposit for information and associated fees.

Please note that all licensees are responsible for filing the Notices of Intention in accordance with the revised rules. Therefore, a copy of the Federal Register notice announcing the final regulations, as amended, (69 FR 34578 dated June 22, 2004), is also available at www.copyright.gov. We encourage you to read this notice carefully for more information on the additional changes.
