General Results from Review of Indian Claims Commission's Compromise Settlements.

  1. The ICC made findings of fact that resulted in 86 cases of compromise settlement (See Final Report of the ICC, Alphabetical Index of Indian Claims Commission Cases through September 1, 1978 at 23-106 and Addendum at 107-111).

  2. The ICC judicially established 176 Indian land areas (See Final Report of the ICC, Map Area Index at 131-137).

  3. Of the 176 Indian land areas, 53 resulted from ICC compromise settlement cases - or 30% of the judicially established Indian land areas were based upon compromise settlements.

Note: Multiple-use or non-exclusive use of an area did not preclude the ICC from determining that a region was the aboriginal land of an Indian tribe or tribes. For example, the Delaware (1/5 owners), Wyandot (1/5 owners), Potawatomi (1/5 owners), Ottawa (1/5 owners), and Chippewa (1/5 owners) were found by the ICC to be the shared aboriginal land holders of a single region (See section 2 on 1978 ICC Map; 30 ICC 8 (1973); affd 207 Ct. Cl. 958 (1975). Upon a preliminary examination of the 1978 ICC Map, there are at least 27 similar shared aboriginal land holder determinations (See Final Report of the ICC, Map Area Index at 131-137). Given these ICC final judgments on the delineation of Indian land areas, it is conceivable that a similar shared aboriginal land holder determination could have been made for the Mid-Columbia region at issue if the following tribes had brought a joint claim: Yakama, Umatilla, Nez Perce, and Colville.
