Tolerance Petitions

EPA receives petitions from pesticide registrants and others, such as the USDA Interregional Research Project Number 4 (IR-4) proposing the establishment and/or amendment of regulations for residues of pesticide chemicals in or on various food commodities under section 408 of the Federal Food, Drug, and Cosmetic Act (FFDCA). EPA determines that the petition contains data or information regarding the requirements for such petitions. EPA does not fully evaluate the sufficiency of the submitted data or whether the data support granting of the petition before making the petition available to the public for comment. Additional data may be needed before EPA rules on the petition.

The petitioner summary of the pesticide petition is published in the Federal Register, as required by section 408(d)(3) of the FFDCA. The summary of the petition was prepared by the petitioner and represents the views of the petitioner. EPA publishes the petition summary verbatim without editing it in any way. The petition summary announces the availability of a description of the analytical methods available to EPA for the detection and measurement of the pesticide chemical residues or an explanation of why no such method is needed.

EPA accepts comments on the petition for 30 days after Federal Register publication. These comments are entered in the docket for the pesticide, and EPA considers them in its review of the petition.
