Status of Sanction Clocks

    Status of Sanction Clocks


    The sanction clock status report includes the following information:
    State, Area, Sub-area
    The state abbreviation and "Part 81" area name, based on the tables in 40 CFR 81.301 - 81.356 listing the nonattainment areas in each state. In some areas, a common name or partial area name is also listed.
    Date Required
    The due date by which the state was to have submitted a complete, approvable component of their State Implementation Plan (SIP), addressing the specific required element.
    Pollutant
    The name of the specific pollutant for which the National Ambient Air Quality Standard (NAAQS) was not attained in the specified area.
    Required element
    The description of the required SIP element that was deficient.
    Date and Type of Finding
    The date when the EPA notified the state that the particular required element had not been received, was incomplete, or was disapproved.
    Date of Submittal
    The date when the state submitted the required element. If never submitted, this will be blank.
    Date of First Sanction
    The date when the EPA is required to impose a sanction against an area, due to continuing lack of the required SIP element.

    Where timely submissions were not made, EPA started sanctions clocks, giving states 18 months to correct deficiencies in state plans before sanctions go into place.
    Finding type: F=failure to submit; I=incomplete submittal; D=disapproved

    States have until the date of first sanction to correct the deficient plans before any sanctions would go into place. EPA Regional Offices are working closely with states and expect the vast majority of clocks to be stopped before the 18 months expire.
