Firm permanently enjoined from future violations

LIBERTY BUILDING AND MAINTENANCE SERVICES INC, COLUMBUS, OHIO, PAYS $2,000 FOR OVERTIME VIOLATIONS

The U.S. Department of Labor announced today that Liberty Building and Maintenance Services Inc., 2758 Cleveland Ave., Columbus, Ohio, has paid $2,000 for overtime violations.

A consent judgment was issued by U.S. District Court Judge Joseph P. Kinneary, Southern District of Ohio, Eastern Division, Columbus, under the Fair Labor Standards Act (FLSA). The court ordered the firm to pay back wages to 12 past or present employees. Liberty Building and Maintenance Services Inc. and Earl Harris, owner, were permanently enjoined from future overtime violations of the FLSA, the federal wage and hour law. The violations occurred during September 1993 to August 1995.

District Director Richard Malloy of the Wage and Hour Division in Columbus said, "This case illustrates that the Labor Department will take all necessary measures to ensure vulnerable low-wage workers are paid properly for all hours worked."

The Labor Department's Wage and Hour Division enforces the FLSA which sets a federal minimum wage of $5.15 for most workers. The law generally requires time and one-half pay for hours worked over 40 in a workweek. The FLSA also requires employers to keep accurate time and payroll records.

The legal action followed an investigation by the Wage and Hour District Office, 200 North High Street, Columbus, Ohio, under the supervision of Richard Malloy, district director.
