PA MISSOURI COMPANY CHARGED WITH NOT REPORTING NEW CHEMICALS

FOR RELEASE: FRIDAY, JANUARY 10, 1997

MISSOURI COMPANY CHARGED WITH NOT REPORTING NEW CHEMICALS

On Dec. 30, 1996, Futura Coatings Inc. of Hazelwood, Mo., was charged in a 14-count criminal information with willfully before manufacturing a new chemical substance for distribution within the United States.  The company could be fined up to $200,000 on each count. Willfully failing to file a notice with EPA prior to manufacturing a new chemical is a criminal violation of the Toxic Substances Control Act. The information alleges that Futura Coatings did not file premanufacture notices for approximately 55,000 pounds of three new chemical substances which it produced between 1991 and 1993. The case was investigated by EPA's Criminal Investigation Division.
