FOR RELEASE: FRIDAY, SEPTEMBER 26, 1997

THREE OKLAHOMAN MEN INDICTED FOR DUMPING HAZARDOUS WASTE

On Sept. 17, Carl Hines, Billy Orange and Daniel Martin were indicted in U.S. District Court for the Eastern District of Oklahoma in Muskogee on charges of illegally storing and transporting hazardous waste and conspiracy to violate the Resource Conservation and Recovery Act. On Feb. 5, Hines, owner of H&J Auto and Salvage in Madil, Okla., had been informed by the Oklahoma Department of Environmental Quality that he would be responsible for the proper transportation and disposal of 34, 55-gallon drums of materials that were stored at the facility. It is alleged that Martin transported 23 of the drums and dumped them in a field in Mill Creek, Okla. and that Orange transported seven of the drums and illegally disposed of them in a field in Sulphur, Okla. If convicted on all counts each faces a maximum of up to 15 years in prison and/or fines of up to $750,000. The case was investigated by EPA’s Criminal Investigation Division, the FBI and the Oklahoma Department of Environmental Quality.
