PA CORPORATION AND ENVIRONMENTAL MANAGER INDICTEDFOR RELEASE: FRIDAY, APRIL 25, 1997 CORPORATION AND ENVIRONMENTAL MANAGER INDICTED Raymond Howell and the Colonel's Factory Outlet (TCFO) of West Memphis, Ark., where Howell formerly was environmental manager, were indicted in U.S. District Court in Little Rock, Ark., on April 9, on three felony counts of violating the Resource Conservation and Recovery Act (RCRA) and one felony count of violating the Clean Water Act (CWA). TCFO is a facility where automobile bumpers are electroplated. The RCRA charges allege that Howell and TCFO illegally stored electroplating sludge containing hazardous levels of nickle and chromium, illegally transported this waste to a facility which was not licensed for hazardous waste disposal and disposed of it there. Under the CWA, Howell and TCFO are accused of violating the city of West Memphis' wastewater pre-treatment requirements by connecting an illegal discharge line to the city's sewer system and discharging untreated wastewater from plating operations into the sewer. Howell faces a maximum of five years in prison and/or fines of up to $250, 000 on each of the hazardous waste counts. He faces a maximum of three years in prison and/or a fine of up to $250,000 on the CWA count. TCFO faces a maximum fine of up to $500,000 on each count. The case was investigated by EPA's Criminal Investigation Division with the assistance of EPA's National Enforcement Investigations Center.
