PA WASHINGTON STATE MAN INDICTED FOR VIOLATING THE CLEAN WATER ACT AND THE CLEAN AIR ACT

FOR RELEASE: FRIDAY, FEBRUARY 20, 1998

WASHINGTON STATE MAN INDICTED FOR VIOLATING THE CLEAN
WATER ACT AND THE CLEAN AIR ACT

On Feb. 11, Tim Tomlinson was indicted in U.S. District Court for the Western District of Washington in Seattle with one felony count of violating the Clean Water Act (CWA) and 10 felony counts of violating the Clean Air Act (CAA). Tomlinson is a partner in the firms of WR Environmental and WR Engineering of Bainbridge Island, Wash. The CWA count alleges that while excavating three underground storage tanks at a former gasoline station in Gig Harbor in October 1996, Tomlinson knowingly allowed the unpermitted discharge of 13,000 gallons of gasoline and gasoline-contaminated water into a catch basin that fed into Henderson Bay. Gasoline contains benzene which is a carcinogen. The CAA counts allege that in May 1997, the defendant improperly removed asbestos from an office building in Seattle, Wash. Tomlinson’s company quoted a $31,000 price to remove the asbestos, but the actual clean up cost was over $350,000 for the property owners. This case was jointly investigated by EPA’s Criminal Investigation Division, the EPA Region 10 Air Program, the Washington State Department of Ecology and the Washington State Department of Labor and Industries.
