PROPOSED CHANGES TO EPCRA REPORTING REQUIREMENTS PROVIDE RELIEF TO GAS STATIONSFOR RELEASE: FRIDAY, MAY 29, 1998 PROPOSED CHANGES TO EPCRA REPORTING REQUIREMENTS PROVIDE RELIEF TO GAS STATIONS As part of EPA’s regulatory reinvention efforts, the Agency is proposing changes to the reporting requirements under the Emergency Planning and Community Right-to-Know Act (EPCRA) that would provide relief to gas stations and facilities that store or handle rock salt, sand and gravel. Under EPCRA sections 311 and 312 facilities that are required to have a material safety data sheet (MSDS) for a hazardous chemical under the Occupational Safety and Health Act of 1970 are required to submit the MSDS as well as an annual emergency and hazard chemical inventory form to the local emergency planning committee, the state emergency response commission and the fire department with jurisdiction over the facility. The proposed changes would raise the reporting thresholds for gasoline and diesel fuel at retail gas stations, provided the facilities are in compliance with underground storage tank regulations. The new reporting threshold would be 75,000 gallons of all grades of gasoline combined and 100,000 gallons for diesel fuel. Facilities that store or handle rock salt, sand and gravel also would be exempt from these reporting requirements because these substances do not present a threat to the public, emergency responders or the environment. Elimination of these reporting requirements would relieve facilities from routine reporting of information that is not useful to the community.
