This action will amend the compliance requirements for vegetable oil production processes that exclusively use a qualifying low-HAP (hazardous air pollutants) extraction solvent. The amendments are being made to require only the necessary recordkeeping and reporting requirements for facilities using the low-HAP extraction solvent compliance option. These amendments are being made by direct final and will be effective November 1, 2004 unless adverse comments are received by October 1, 2004.

DIRECT FINAL RULE; AMENDMENTS

On March 23, 2000, EPA promulgated national emission standards for hazardous air pollutants (NESHAP) for secondary aluminum production under section 112 of the Clean Air Act (CAA), and on September 24, 2002, and on December 30, 2002, EPA published final amendments to the standards to the standards based on two separate settlement agreements. These amendments further clarify regulatory text, correct errors, and improve understanding of the rule requirements as promulgated. The revisions are viewed as noncontroversial and no adverse comments are anticipated. This direct final rule is effective November 2, 2004 without further notice unless EPA receives adverse written comments by October 4, 2004.

FINAL RULE

The EPA is promulgating national emission standards for hazardous air pollutants (NESHAP) for industrial boilers and process heaters which have been identified as major sources of hazardous air pollutants (HAP) emissions. The final rule will implement section 112 (d) of the Clean Air Act (CAA) by requiring all major sources to meet HAP emission standards reflecting the application of the maximum achievable control technology (MACT). The final rule also contains numerous compliance provisions including health-based compliance alternatives for the hydrogen chloride and total selected metals emission limits.

This action amends the parametric operating limits and associated compliance provisions for capture systems used to control emissions from pushing. This action also amends the requirements for mobile scrubber cars that capture emissions during pushing and travel.

The Clean Air Act (CAA) authorizes EPA to reclassify certain ozone nonattainment areas shortly after the initial classification for such areas. In the April 30, 2004 Federal Register action establishing the 8-hour ozone designations and classifications, EPA described this reclassification process and listed criteria the Agency intended to use to evaluate a reclassification request. This rule reclassifies certain areas that are designated nonattainment for the 8-hour ozone national ambient air quality standards (NAAQS).

This document announces the final action by EPA to change the listing of HCFC-141b from acceptable to unacceptable for use as a foam blowing agent under the Significant New Alternatives Policy (SNAP) Program under Section 612 of the Clean Air Act. This decision was based on information received by the Agency from outside parties through letters, meetings and the HCFC-141b Exemption Allowance Petition process (68 FR 2819) that addresses the use of HCFC-141b in foam blowing applications. This information was made publically available in a Notice of Data Availability (NODA) issued by the Agency on March 10, 2004. Both the information contained in the NODA as well as the public comments it generated contributed to the final decision made by EPA.

The California Air Resources Board (CARB) has notified EPA that it has adopted amendments to the California heavy-duty diesel regulations for 2007 and subsequent model year vehicles and engines and related test procedures including the not-to-exceed (NTE) and supplemental steady-state tests to determine compliance with applicable standards. By letter dated July 16, 2004, CARB submitted a request that EPA grant a waiver of preemption under section 209 (b) of the Clean Air Act (CAA), 42 U.S.C. 7543 (b) for these amendments. This notice announces that EPA has tentatively scheduled a public hearing concerning California's request on December 15, 2004, and that EPA is accepting written comment on the request.
