State UIC Programs

EPA can authorize states to implement the UIC program. States have the option of applying for primary responsibility, or primacy, for the UIC program for all classes of wells; only oil and gas related wells (class II wells); or all wells except oil and gas related wells (classes I, III, IV and V).   If a state does not obtain primacy for all or some of the well classes, then EPA implements the program directly through one of its Regional offices. Native American tribes also follow the same rules for obtaining primacy if they are considered a "Federally Recognized Tribe" and have been designated as "Treatment Similar to a State".  To date the UIC program in all Native American lands is implemented by EPA. EPA has delegated primacy for all well classes to 34 states, it shares responsibility in 6 states and implements a program for all well classes in 10 states. The Agency has also delegated primary enforcement responsibility to 3 territories.  EPA provides grant funds to all delegated programs to help pay for program costs. States must provide a 25% match on EPA funds.  The graphic below shows the breakdown of responsibility for the UIC program in the states.  A list of the primacy status of states is also available.
