Questions and Answers on Implementation

This question and answer document was prepared to provide guidance on
the implementation of the phase II rule. As we receive additional questions
from permit writers, industry, environmental groups, and other members
of the public, this document will be updated.
There are three rulemaking phases:
Phase I rule, promulgated in 2001, covers new
facilities
Phase II rule, promulgated in 2004, covers large
existing electric generating plants
Phase III rule, proposed November 1, 2004, would
cover certain existing facilities and new offshore and coastal oil and
gas extraction facilities
