What's New

A new NSR Website has been created. The latest information about NSR will be posted at the new site. This (TTN) site will no longer be updated. The information contained here will remain for historical purposes until we are certain it is available by other means (the new site, the Region VII database, the docket, etc).

This page announces recent and upcoming events of interest to the NSR community and directs the user to available materials associated with them. Also announced are recent EPA-generated documents relevant to New Source Review and their location on this Web site.

8-8-02 3/29/01 Letter to J. Hornback, Director, Kentucky Division Air Quality regarding EPA's agreement with the State's conclusion that the Gallatin steel manufacturing facility and the Heckett MultiServe (a division of Harsco Corporation) should be considered single sources. Letter can be found under Uncategorized Policy and Guidance Documents.

8-8-02 8-10-01 Response letter to an April 16, 2001 from H. Nickel, Hunton & William requesting EPA's opinion on whether the Maricopa County Environmental Services Department (NCESD) had correctly interpreted and applies EPA's nonattainment NSR rules and applicable guidance in determining that the proposed Kyrene Expansion Project (KEP) at the Kyrene Generating Station, located in Tempe, Arizona, (Permit No. V95-009) was subject to nonattainment NSR requirements (including offsets) for PM-10. 10-11-01 The EPA is making available for public review and comment a preliminary draft of its pending guidance on Source Determinations for Combined Heat and Power (CHP) Facilities under the Clean Air Act New Source Review and Title V Programs. The two files can be found under Draft Documents for Public Review & Public Comments section. The comment period on the draft guidance will close on November 14, 2001.

8-6-01 August 6, 2001 response letter to an April 26, 2001 from P. Raher, Hogan & Hartson L.L.P. on behalf of PSEG Fossil for a formal determination about whether cycle gas turbine systems qualify as "electric utility steam generating units" for purposed of determining applicability of NSR. 6-26-01 - June 5, 2001 - EPA letter responding to a request for guidance for calculating actual or potential emissions of certain regulated pollutants from new sources and modifications to determine their applicability to title I, part C and D (new source review), and title V (operating permit), requirements. This letter has been added to the Uncategorized Policy and Guidance Documents section.

4-10-01 - Newly posted is a letter from Harnett, Director, OAQPS responding to a 2/27/01 request from W. Lewis, Morgan, Lewis & Bockius, LLP for a determination that the Federal NSR requirements do not apply to Minnesota Power's proposed purchase of the electric generating assets owned by LTV Steel in Taconite Harbor, Minnesota. This letter has been added to the Uncategorized Policy and Guidance Documents section.

3-15-01 - The New Source Review Improvement Rulemakings with a list of the concepts that have been developed and supported by Perciasepe is now available. This document is found at http://www.epa.gov/ttn/nsr/rule_dev.html.

1-23-01 - The Cover Memo and Supplemental Report for Tier 2/Gasoline Sulfur Refinery Projects: Guidance Document/BACT and LAER for Emissions Nitrogen Oxides and Volatile Organic Compounds have been added to the Uncategorized Policy and Guidance Documents section.

1-12-01 - The August 12, 2000 Letter from Robert Perciasepe to Terry M. White on Emergency Generator Guidance during Power Blackouts has been added to the Uncategorized Policy and Guidance Documents section.

10-3-00 - The EPA is making available "public comments" on the preliminary draft of its pending guidance on BACT for NOx Control on dry low NOx turbines on combined cycle units. They can be found at the following website: http://www.epa.gov/ttn/nsr/draft.html.

9-5-00 - 9/5/00 The EPA is making available for public review and comment the Information Collection Request (ICR) for Prevention of Significant Deterioration and Nonattainment New Source Review to the Office of Management and Budget. The EPA is soliciting comments on specific aspects of the proposed information collection. Comments must be submitted on or before November 6, 2000. A narrative explaining the adjustments requested to the NSR Year 2000 Information Collection Request and the Federal Register notice can be found at http://www.epa.gov/ttn/nsr/techinfo.html.

8-10-00 - The EPA is making available for public review and comment a preliminary draft of its pending guidance on BACT for NOx Control on dry low NOx turbines on combined cycle units. Several issues have been brought to EPA's attention as a result of recent controversies involving State permitting agencies, utilities, and turbine manufacturers over appropriate best available control technology (BACT) controls for NOx at natural gas combined cycle turbines for electric power generation. Selective Catalytic Reduction (SCR) has been considered BACT for limiting NOx emissions on many natural gas combined cycle turbines in attainment areas. These issues have to do with the impact of requiring selective catalytic reduction on dry low NOx natural gas combined cycle turbines for electric generations. The Notice of Availability for this draft guidance was signed by John Seitz on August 9, 2000 and will be published soon in the Federal Register. The EPA is taking comments on this draft guidance until 30 days after the Notice of Availability is published in the Federal Register. The EPA does not intend to respond to individual comments, but rather to consider comments and information from the public in the preparation of a final guidance document. It is important that the draft guidance being made available today for public review and comment does not represent official EPA policy or a formal position on the subject matter discussed and therefore is not to be relied on in interpreting EPA policy. 8-9-00 - The EPA is making available for public review and comment a draft guidance, "Design of Flexible Air Permits" (White Paper Number 3). The Notice of Availability for this draft guidance was signed by John Seitz on August 7, 2000 and will be published soon in the Federal Register. The EPA is taking comments on this draft guidance until 30 days after the Notice of Availability is published in the Federal Register. The EPA does not intend to respond to individual comments, but rather to consider comments and information from the public in the preparation of a final guidance document. It is intended to help State and local permitting authorities design flexible permits for sources subject to title V of the Clean Air Act. It focuses on how these permitting authorities can design operating permits, within the scope of title V of the Clean Air Act and the operating permits regulations. This draft guidance provides sources with the flexibility to more quickly change to different modes of operation, as the nature of their business requires, without being unnecessarily impeded by the terms of their operating permit. This draft guidance would also advance the Agency's goals of encouraging pollution prevention, assuring adequate public participation, promoting equal or better environmental protection, and facilitating opportunities for sources to comply in a smarter, more efficient fashion.

6-29-00 - The EPA is making available for public review and comment a preliminary draft of its pending guidance for States who choose to use emissions reductions from motor vehicles operated on low sulfur gasoline as new source review offsets. Offsets are one prerequisite for major stationary sources or major modifications seeking permit approval in nonattainment areas. On February 10, 2000, EPA issued new rules containing emissions standards ("Tier 2 standards") for all passenger vehicles, including sport utility vehicles, minivans, vans and pickup trucks. To ensure the effectiveness of low emission control technologies in these vehicles, EPA's new rules also set standards to significantly reduce the sulfur content in gasoline. To assist refineries and States who may otherwise have difficulty acquiring emissions reductions to offset proposed emissions increases at affected refineries, EPA intends to provide Federal guidance on the use of Tier 2 emissions reductions as NSR offsets. The EPA does not intend to respond to individual comments, but rather to consider comments and information from the public in the preparation of a final guidance document. 5-25-00 - A letter dated May 23, 2000 with enclosure to Henry Nickel from Region V per an applicability determination for the replacement and reconfiguration of steam turbines at Detroit Edision's Monroe Power Plant had been added to the Uncategorized Policy and Guidance Documents section.

5-2-00 - A September 1999 Memorandum on Excess Emissions During Malfunctions, Startup and Shutdown has been added to the Uncategorized Policy and Guidance Documents section.

3-20-00 - The EPA is making available for public review and comment a preliminary draft of its pending guidance on BACT and LAER for Tier 2/gasoline sulfur refinery projects. On February 10, 2000, EPA issued new emissions standards ("Tier 2 standards") for all passenger vehicles, including sport utility vehicles, minivans, vans and pickup trucks. 1-5-00 - We mistakenly did not include a stakeholder proposal in our initial mailout of background information for the January 13 meeting on an alternative approach to NSR for utilities. Please pardon our error. As with the other attachments, it is provided for background purposes, and will not be directly discussed at the stakeholder meeting. The file is in a Power Point format.

12-27-99 - Announcement for public hearing on 1/3/2000 to discuss EPA's thinking on an alternative approach for compliance with the New Source Review (NSR) requirements. Documents are in WP, and PDF formats.

8-9-99 - An Order was signed by the Administrator on June 16, 1999 denying a Petition from Kawaihae Cogeneration Partners (KCP) requesting EPA to object to a PSD/Covered Source permit issued to Maui Electric Company (MECO) for the construction and operation of two 20 megawatt combustion turbines to be located at MECO's Maalaea Generating Station. The permit was issued by the Hawaii Department of Health (DOH) and constituted both a construction permit issued pursuant to the PSD regulations (delegated to DOH in 1983) and a state operating permit issued pursuant to Title V. KCP petitioned EPA to object to the permit on the grounds that the project had not applied BACT for the control of NOx and SO2 emissions. EPA denied the Petition because the appeal was based on PSD issues and only the Environmental Appeals Board has the authority to review the merits of a federal PSD permit. 5-12-99 - The Economics and Cost Analysis Support (ECAS) Web site is now available as a TTNWeb Web site. Documents developed by the Innovative Strategies and Economics Group (ISEG) can now be found in one place. These documents include analyses of costs, benefits, and economic and regulatory impacts of air quality management strategies, programs, and regulations developed throughout the Office of Air Quality Planning and Standards (OAQPS).

2-12-99 - A 1992 memorandum on transitional guidance (supplement to the March 1991 Transition Guidance) has been added to the Uncategorized Policy and Guidance Documents section. The file is in both a Word Perfect Format and a PDF format.

2-2-99 - A PDF version of the October 1980 NSR Workshop Manual has been made available by EPA Region VII and is located under "Technical Information" along side the ZIP version of the (October 1980) NSR Workshop Manual which has a file date of 8/19/94.

12-9-98 - December 4, 1998, Treatment of Aluminum Die Casting Operations for the Purposes of New Source Review Applicability has been released in a Word Perfect format on the NSR board.
