REFERENCES: Statutes that amended the Low Income Home Energy Assistance Act of 1981 (title XXVI of the Omnibus Budget Reconciliation Act of 1981, Public Law 97-35): section 16 of the Older Americans Act Amendments of 1981 (Public Law 97-115); title VI of the Human Services Reauthorization Act of 1984 (Public Law 98-558); title V of the Human Services Reauthorization Act of 1986 (Public Law 99-425); title VII of the Augustus F. Hawkins Human Services Reauthorization Act of 1990 (Public Law 101-501); title III of the Human Services Amendments of 1994 (Public Law 103-252); section110(p) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (Public Law 104-193); and title III of the Coats Human Services Reauthorization Act of 1998 (Public Law 105-285).

PURPOSE: To transmit a current compilation of the Low Income Home Energy Assistance Act that incorporates all of the amendments made to it to date.

BACKGROUND: The attached compilation of the Low Income Home Energy Assistance Act includes all amendments made to it through August 1999. The most recent amendments to the LIHEAP statute were made by the Low Income Home Energy Assistance Amendments of 1998 (title III of the Coats Human Services Reauthorization Act of 1998, Public Law 105-285, enacted October 27, 1998), which reauthorized the LIHEAP program through FY 2004.

Also attached are two additional statutory provisions that are relevant to the LIHEAP program: (1) section 927 of the Housing and Community Development Act of 1992 (Public Law 102-550), as amended by Public Law 103-185 on December 14, 1993, which applies to treatment under the LIHEAP program of certain households that receive utility allowances under programs administered by the U.S. Department of Housing and Urban Development; and (2) section 308 of the Low Income Home Energy Assistance Amendments of 1998 (title III of Public Law 105-285), which provides for evaluation by the U.S. Comptroller General of the LIHEAP Residential Energy Assistance Challenge (REACH) program.

LIHEAP grantees must comply with these federal laws. HHS and other federal agencies must comply with them as well.
