TYPE OF ALERT: DETENTION WITHOUT PHYSICAL EXAMINATION (Note: This import alert represents the Agency's current guidance to FDA field personnel regarding the manufacturer(s) and product(s) at issue. It does not create or confer any rights for or on any person, and does not operate to bind FDA or the public.) PRODUCT: Soft cheese (*** includes soft, semi-soft and soft ripened) made from pasteurized milk. Cheeses which are made from unpasteurized milk and are aged for minimum of 60 days at 35 degrees F. are not covered under this import alert. *** (Reference Compliance Program 7303.037 "Domestic and Imported Cheese and Cheese Products for the types of cheeses for each of the above categories.) MANUFACTURER/ SHIPPER: See Attachment B MANUFACTURER/ SHIPPER ID#: N/A IMPORTER'S ID#: N/A CHARGE: "The article is subject to refusal of admission pursuant to Section 801(a)(3) in that it appears to be injurious to health because it may contain Listeria monocytogenes, a poisonous and deleterious substance [Adulteration, 402(a)(1)]." RECOMMENDING OFFICE: Division of Import Operations and Policy, HFC-170 REASON FOR ALERT: Early in 1986, Listeria monocytogenes was isolated from a sample of French brie cheese. Brie cheese from that plant was detained without physical examination. During March 1986, additional sampling of imported cheeses uncovered further findings of Listeria contamination from French cheese plants. Cheese from France was detained without physical examination in mid-1986. As a result of continued sampling, soft cheeses from other countries were found to contain Listeria and were subsequently detained without physical examination on a case by case basis. On January 16, 1987, the ACRA agreed to the December, 1986, revision of the French Plant and Product Certification Program which included a requirement for use of pasteurized milk and Listeria testing for soft-ripened cheeses and goat cheeses. CERTIFICATION PROGRAM DESCRIPTION: In 1974, a certification program was initiated in France under which only those plants, certified by the French government to be following good manufacturing practices, were permitted to export soft-ripened cheese to the United States. In January, 1987, it was agreed that the requirement for the use of pasteurized milk and Listeria testing would be covered under this program which was subsequently expanded to certify goat cheeses as well. ATTACHMENT A: This is a list of French plants certified by the French Ministry of Agriculture to export only pasteurized milk soft-ripened and goat cheeses to the United States. The plant numbers on this list are considered confidential and are provided for FDA use only. The list provides the following information: Department: French administrative division where the plant is located. Name and address of plant Plant Identification: The new approval numbers are 7 or 8 digits, the first five of which reflect the old approval number. Basic Agreement (Agrement BASIC (I)): Date for which the plant has been certified for absence of E.coli, fecal coliforms, Staphylococcus, Salmonella, and Shigella in the final products. Listeria Agreement (Agrement Listeria): The date for which the plant has been certified for absence of Listeria monocytogenes in the final product(s). Products: Type of cheese manufactured by the plant and the certification status that has been granted. When certification status varies between products, the plant is repeated for each product. The following abbreviations are used to describe the types of products: F= Soft-ripened cheese with flourished crust (Example: Brie) G= Goat Cheese M= Soft-ripened cheese made from cow's and goat's milk W= Soft-ripened cheese with washed crust (Example: Pont l'Eveque) X= Soft-ripened flavored cheese E= Soft ripened cheese from ewe's (sheep) milk Y= soft cheese (feta type cheese from cow's milk) GUIDANCE: Districts may detain soft cheeses from French plants, without physical examination, which are not listed on Attachment A. French plants listed in Attachment A are covered by the certification program and are to be considered in compliance and exempt from detention without physical examination. Although districts may see certificates attached to entry documents, certificates are no longer required. If the firm is listed in Attachment A this will serve as documentation that the firm participates in the certification program. Attachment A will be updated periodically as new information is received from the French government. Districts may detain cheese from manufacturers listed in Attachment B without physical examination. Attachment B provides a list of ALL foreign firms which should be detained without physical examination for the presence of Listeria monocytogenes. Immediately report all detentions for L. monocytogenes to CFSAN,*** HFS-606, at 202-436-2413.*** Recommendations to place a firm on detention without physical examination should be sent to DIOP, HFC-170. Refer to the Domestic and Imported Cheese and Cheese Products Compliance Program (CP7303.037) for sampling, analytical, and regulatory guidance. (Please NOTE: samples can also be analyzed for phosphatase and other microorganisms. Attachment C provides the names of French cheeses covered under the import alert and those cheeses normally made from raw milk.
