CHICAGO (Aug. 31, 2004) -- U.S. Environmental Protection Agency
Region 5 has reached an agreement with Midwest Energy Resources
Co. on alleged clean-air violations at the company's coal transfer
facility, West Winter Street, Superior, Wis. EPA assessed a $69,750
penalty.
The agreement resolves EPA allegations that Midwest Energy violated
conditions of its federally enforceable state operating permit
related to baghouses and scrubbers designed to control coal-dust
emissions from the facility.
In a related action, EPA issued a consent order requiring Midwest
Energy to replace or repair six existing baghouses to improve performance
and to undertake process improvements that will cut coal-dust emissions
by 125 tons per year.
Inhaling high concentrations of coal dust can affect children,
the elderly and people with heart and lung diseases the most.
