Legal Notices for Google Maps

The following are various legal notices that Google is obligated to provide by law and/or by contract.

Google Local and Map Data

Capitalized terms used in this section have the meanings described in the Google Terms of Service or in the Google Maps Terms of Service.

These Legal Notices are incorporated by reference into the Google Maps Terms of Service and by using Google Maps, you are agreeing to be bound by these additional provisions.

Government End Users: If the map data provided by NAVTEQ or TANA is used or accessed by or on behalf of the United States government or any other entity seeking or applying rights similar to those customarily claimed by the United States government, such use or access is subject to the following provisions:

For TANA data: If you are an agency, department, or other entity of the United States Government, or funded in whole or in part by the United States Government, then your use, duplication, reproduction, release, modification, disclosure or transfer of this commercial product and accompanying documentation, is restricted in accordance with the LIMITED or RESTRICTED rights as described in DFARS 252.227-7014(a)(1) (JUN 1995) (DOD commercial computer software definition), DFARS 227.7202-1 (DOD policy on commercial computer software), FAR 52.227-19 (JUN 1987) (commercial computer software clause for civilian agencies), DFARS 252.227-7015 (NOV 1995) (DOD technical data – commercial items clause); FAR 52.227-14 Alternates I, II, and III (JUN 1987) (civilian agency technical data and noncommercial computer software clause); and/or FAR 12.211 and FAR 12.212 (commercial item acquisitions), as applicable. In case of conflict between any of the FAR and DFARS provisions listed herein and this License, the construction that provides greater limitations on the Government's rights shall control. For purpose of any public disclosure provision under any federal, state or local law, it is agreed that the Licensed Products are a trade secret and a proprietary commercial product and not subject to disclosure.

If you are an agency, department, or other entity of any State government, the United States Government or any other public entity or funded in whole or in part by the United States Government, then you hereby agree to protect the Licensed Products from public disclosure and to consider the Licensed Products exempt from any statute, law, regulation, or code, including any Sunshine Act, Public Records Act, Freedom of Information Act, or equivalent, which permits public access and/or reproduction or use of the Licensed Products.

For NAVTEQ data: If the map data provided by NAVTEQ is is used or accessed by or on behalf of the United States government or any other entity seeking or applying rights similar to those customarily claimed by the United States government, (i) for acquisitions or access conducted by the Department of Defense, map data provided by NAVTEQ is licensed with "Limited Rights" in accordance with the rights set forth at DFARS 252.227-7013(b)(3), TECHNICAL DATA-NONCOMMERCIAL ITEMS, and NAVTEQ Data delivered or otherwise furnished with "Limited Rights" shall be marked with the following "Limited Rights Notice" set forth at DFARS 252.227-7013(f)(3), and shall be treated in accordance with such Notice:

The Government's rights to use, modify, reproduce, release, perform, display, or disclose these technical data are restricted by paragraph (b)(3) of the Rights in Technical Data-Noncommercial Items clause contained in the above identified contract. Any reproduction of technical data or portions thereof marked with this legend must also reproduce the markings. Any person, other than the Government, who has been provided access to such data must promptly notify the above named contractor.

and; (ii) for civilian agency acquisitions or access, map data provided by NAVTEQ is licensed in accordance with the rights set forth at FAR 52.227-14(g)(1), RIGHTS IN DATA-GENERAL (Protection of limited rights data and computer software). In the event that the Contracting Officer (as defined in such regulation) requires the delivery of limited rights NAVTEQ map data that has been withheld or would otherwise be withholdable in accordance with FAR 52.227-14(g)(1), the map data provided by NAVTEQ is licensed with "Limited Rights" as set forth in the following "Limited Rights Notice" at FAR 52.227-14(g)(2) (Alternate II), which shall be affixed to the map data provided by NAVTEQ and the such data shall be treated in accordance with such Notice (which shall be marked on any reproduction of these data, in whole or in part):

LIMITED RIGHTS NOTICE (JUN 1987)
These data are submitted with limited rights under Government Contract No. _____ (and subcontract ______, if appropriate). These data may be reproduced and used by the Government with the express limitation that they will not, without written permission of the Contractor, be used for purposes of manufacture nor disclosed outside the Government; except that the Government may disclose these data outside the Government for the following purposes, if any, provided that the Government makes such disclosure subject to prohibition against further use and disclosure: There are no additional purposes permitting disclosure of such data.
The manufacturer/supplier of the Data is NAVTEQ, 222 Merchandise Mart Plaza, Suite 900, Chicago, Illinois 60654.

If the Contracting Officer refuses to use either of the licenses provided in (i) or (ii), herein, the Contracting Officer must notify NAVTEQ prior to seeking additional or alternative rights in map data provided by NAVTEQ.

Additional restrictions regarding muncipal boundaries

Data regarding municipal boundaries may not be used to create or derive applications which are used for the purpose of tariff or tax rate determination for a particular address or range of addresses.

International data sources:

For Canadian data, the following provisions may apply:

Google Maps map data may include or reflect data of licensors, including Her Majesty and Canada Post. Such data is licensed on an "as is" basis. The licensors, including Her Majesty and Canada Post, make no guarantees, representations or warranties respecting such data, either express or implied, arising by law or otherwise, including but not limited to, effectiveness, completeness, accuracy or fitness for a particular purpose.

The licensors, including Her Majesty and Canada Post, shall not be liable in respect of any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action alleging any loss, injury or damages, direct or indirect, which may result from the use or possession of the map data accessed from or through Google Maps. The licensors, including Her Majesty and Canada Post, shall not be liable in any way for loss of revenues or contracts, or any other consequential loss of any kind resulting from any defect in the map data accessed from or through Google Maps.

You shall indemnify and save harmless the licensors, including Her Majesty the Queen, the Minister of Natural Resources of Canada and Canada Post, and their officers, employees and agents from and against any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action, alleging loss, costs, expenses, damages or injuries (including injuries resulting in death) arising out of the use or possession of the map data accessed from or through Google Maps.

The data used to create the mapping images or map based content for Australia or New Zealand is copyrighted © by MapData Sciences Pty Ltd or one of its licensors (see www.nowwhere.com.au/lic/NowWhereLic1.htm). Use of such data is permitted only for Google Services. It is a condition of the licence that any unauthorized copying or reproduction of the content in any form, or by any means, is not permitted. Without in any way limiting the generality of the above you, or any user of this data shall not copy any of the content by any means including magnetic, digital, rasterising, scanning, digitizing, any electrostatic method, fax or photocopying. You may not attempt to reverse engineer any output that would allow the recreation of any digital mapping data, including but not limited to any form of geocodes. Your use of mapping data is permitted only for personal use (unless You are a business user where You can use the mapping data for internal use, and in accordance with Google's terms which apply to the relevant product) via Google's services.

Unless authorised by these terms or Google's applicable terms of use, You may not: (a) copy, duplicate, reproduce, modify, sell, trade, resale, reverse engineer, create derivatives, digitize, translate or transcode the mapping data: (b) use the mapping data with any products, systems, functions or applications otherwise connected to or in communication with vehicles, vehicle navigation, positioning, dispatch, real time route guidance, fleet management, force management or similar application.

You undertake full responsibility and risk related to your use of the mapping data. Mapa is not responsible to You for the mapping data and does not make or give to You any representations or warranties, express and implied, in connection with the mapping data, including, but not limited to, the accuracy, completeness, reliability or usability of the mapping data. Therefore, Mapa is not liable to You for any damage or claim whatsoever, direct or indirect, arising from Your use the mapping data.

The Google Maps Japan service includes business listing data which has been modified by Google based on copyrighted data from third parties. Using such data without permission may violate copyrights held by Google or other parties, and commercial use is strictly prohibited. You may not take business listing data.

Neither Google nor third parties that license data appearing in Google Maps shall be responsible for any damages, including consequential damages, arising from the use of this data.

The KANJIDIC dictionary files used to create the mapping images or map based content for Japan is copyrighted © by the Electronic Dictionary Research and Development Group, and are used in conformance with the Group's license.

Netherlands

Norway

MultiNet™ data of Norway may not be used to create general purpose printed or digital maps, such as road maps and atlas, which are similar to the basic national products of the Norwegian Mapping Authority. (Any derivative product of the MultiNet™ data of Norway shall be regarded as similar to the basic national products of the Norwegian Mapping Authority if such derivative product has a regional or national coverage, and at the same time has a content, scale and format that are similar to the basic national products of the Norwegian Mapping Authority.)

MultiNet™ data of Poland may not be used to create commercial printed maps or map products.

Google Local Listings in France and Germany

When you search for local listings in France and Germany, your search results may include content (including business listings and related information) which has been supplied by Kapitol S.A. (trading as Infobel) (the "Infobel Content"). The intellectual property rights in the Infobel Content are owned by Kapitol S.A. or its licensors. The Infobel Content may only be used in accordance with these Terms of Service and the applicable terms and conditions of Kapitol S.A. If you know that your business listing is supplied by Kapitol S.A., and you have any questions about it you should contact them directly.

Google Local Business Listings

When you search for local listings, Google displays business listings which may be supplied by Acxiom or infoUSA. This information is proprietary to those corporations and is protected under U.S. copyright law and international treaty provisions. This information is licensed for your personal or professional use and may not be resold or provided to others. You may not distribute, sell, rent, sublicense, or lease such information, in whole or in part to any third party; and you will not make such information available in whole or in part to any other user in any networked or time-sharing environment, or transfer the information in whole or in part to any computer other than the PC used to access this information.
