The Appointment Process for the Panel is specifically outlined in the Ticket to Work and Work Incentives Improvement Act of 1999. There are twelve (12) Panel members. The President, the Senate and the House of Representatives each appoint four. The President may not appoint more than two from the same political party.

Members must have experience or expert knowledge as recipients, providers, employers or employees. They must be from the fields of employment services, vocational rehabilitation and other disability related support services. They can be individuals with disability, advocates or professionals. A majority of the members appointed must be individuals with disabilities or representatives of individuals with disabilities. The group must including current and former disability beneficiaries of Social Security. The President designates the Chairperson of the Panel to serve a term of 4 years.

Generally, an appointment to the Panel is for a period of four years. In the first round of appointments, half of the members were appointed for only two years so that in the future, no more than half of the members will rotate off the Panel creating vacancies to be filled at any one time. There can be other reasons for vacancies to be filled in alternate years but generally half the members will rotate off every two years.
