Under the Employee Retirement Income Security Act (ERISA), PBGC may not divide the pension of a person involved in a divorce unless PBGC receives a domestic relations order that meets certain legal requirements. This is known as a qualified domestic relations order (QDRO). The model QDROs and accompanying information in PBGC's booklet, "Divorce Orders & PBGC," are intended to assist parties by making it easier to comply with statutory requirements.
